论行业自治的正当性

【摘要】：行业自治是行业协会的固有属性,对国家或者其他平等主体而言,自治是行业协会的权利,是会员以集群方式实现个人权利的手段;对其内部成员而言,自治是行业协会的权力,属于社会公权力范畴。行业自治的本质是共同体自治,符合共同体自治的利益要素、组织要素和运行机制要素。在法哲学上,行业自治的基础在于"个人意志最高",并取决于行业协会的精神独立性和协会事务的高度专业化。国家与社会的分立决定了国家和社会必须各司其职,凡是行业协会能够自主解决的事项,国家不得任意干涉,行业自治是国家与社会二元分立的产物。
[Abstract]:Industry autonomy is the inherent attribute of trade association. For the state or other equal subjects, autonomy is the right of trade association and the means for members to realize individual rights in the form of cluster. Autonomy is the power of trade associations, belonging to the scope of public power. The essence of industry autonomy is community autonomy, which accords with the interest elements, organizational elements and operating mechanism elements of community autonomy. In the philosophy of law, the foundation of profession autonomy lies in the highest individual will, and depends on the spiritual independence of the trade association and the highly specialized affairs of the association. The separation of the state and the society determines that the state and the society must perform their respective duties. The state shall not interfere in the matters which the trade association can solve independently. The autonomy of the industry is the result of the dualistic separation of the state and the society.
