公共服务外包过程中个人信息保护的风险管理研究

【摘要】：我国正处于经济发展与社会转型的关键时期。通过公共服务外包,能够改变政府自办服务的模式,有利创新公共服务的体制机制,提高公共服务的效率和品质,建设服务型政府。但政府部门在公共服务外包中,会出现公共服务外包机构和人员以及服务过程中使用的产品不可靠造成的个人信息泄露问题以及政府部门对外包机构和人员管理不善造成的个人信息泄露问题。因此,研究我国政府公共服务外包的个人信息保护的风险管理,寻求当前和未来我国公共服务外包过程中的个人信息保护,对于促进我国公共服务外包服务的顺利进行,有着重要的理论意义和现实意义。本文以个人隐私权保护和风险管理理论作为理论基础,对国内外相关研究作了综述。从公共服务外包、个人信息及个人信息保护的概念界定谈起,对我国公共服务外包政策和个人信息保护相关立法作了仔细梳理,对公共服务外包过程中造成个人信息安全风险的原因作了深入分析,针对这些原因探寻了完善公共服务外包过程中个人信息安全风险管理的对策。尤其在承包商方面的原因和对策研究中以TCNET为个案,提供了真实可靠的论证资料,以使得分析更加客观深入。
[Abstract]:Our country is in the key period of economic development and social transformation. Through public service outsourcing, it can change the mode of government self-service, help to innovate the institutional mechanism of public service, improve the efficiency and quality of public service, and build service-oriented government. But in public service outsourcing, The problems of personal information leakage caused by unreliable products used in public service outsourcing institutions and personnel and personal information leakage caused by government departments' mismanagement of outsourcing agencies and personnel will occur. Therefore, to study the risk management of personal information protection in the public service outsourcing of our country, and to seek the personal information protection in the process of public service outsourcing in our country at present and in the future, will promote the smooth progress of the public service outsourcing service in our country. It has important theoretical and practical significance. Based on the theory of personal privacy protection and risk management, this paper summarizes the related researches at home and abroad. Starting from the definition of public service outsourcing, personal information and personal information protection, this paper makes a careful analysis of the public service outsourcing policy and the relevant legislation of personal information protection in China. The causes of personal information security risk in the process of public service outsourcing are deeply analyzed, and the countermeasures to perfect the personal information security risk management in the process of public service outsourcing are explored. Especially in the research of contractor's reasons and countermeasures, TCNET is taken as a case to provide real and reliable evidences, so as to make the analysis more objective and in-depth.
