【摘要】：毛泽东在1917年发表的《体育之研究》中强调,体育是养生之道也,“故夫体育非他,养乎吾生,乐乎吾心而已。”从中我们可以清楚地看出,体育对于人类强身健体有十分重要的作用。青少年是国家发展的未来希望,自新中国成立以来,党和政府发表了一系列文件,十分重视青少年的体质。但目前我国青少年体质下降成了困扰家庭、学校、社会发展的重要问题,究其原因,体育风险的存在是影响学校体育开展的重要因素。可以说,学平险的普及已经很好的保障了学生意外伤害事故的赔偿问题,而校方责任险也很好的分担了学校的责任。但是从这两个险种在处理学校意外伤害事故中的缺失,使得学校体育活动中大强度高危项目的风险不能很好的转移,学校体育活动的开展得不到进一步的保障。面对学生体质的不断下滑,体育风险的客观存在,面对学校教育、国家发展的实际需求,在中小学范围内针对学校体育增设“中小学体育保险”这一险种显得尤为重要。为此,本研究依据保险学原理,在学校体育教育的视角上,对中小学体育保险增设的必要性和可行性进行了系统的分析和研究,旨在给有关教育行政部门、学校、家庭支持引入学校体育保险提供参考依据,为学校体育工作的开展保驾护航。本文主要运用文献资料法、案例分析法、实地访谈法以及逻辑分析法等研究方法,对我国中小学体育保险增设的必要性和可行性进行了系统的分析和研究,得出以下结论:1、由于学平险、校方责任险在处理学校意外伤害事故中保险责任的缺失及学校体育风险的客观存在,使很多学校在体育与健康课上不敢开展器械体操、攀爬类等运动项目,对风险较大的中长跑项目也持谨慎态度,“每天锻炼一小时”已基本落实,但体育活动太温柔,锻炼强度不足,单双杠、云梯在课余体育锻炼中遇冷,“学生体质下滑仍未止跌”是当前由于学校体育保险缺失所造成的我国中小学体育工作开展的现状。2、学校体育风险具有偶然性、意外性、不是投机性的、具备大量标的遭受损失的可能性、损失有重大性及可以用货币计量,满足可保风险的条件。学校体育保险与学校现有险种学平险和校方责任险的关系是各有优势并相互补充。因此增设中小学体育保险,使三者结合能更好的为学校体育工作的开展保驾护航。3、增设学校体育保险能满足我国学校教育环境发展的需要;能打破学校体育风险转移方式的局限性,进一步确保学校体育风险的有效转移;能营造和谐的校园环境,进一步维护和健全学校的安全管理制度;能够有效保障体育教师的权益,充分发挥教师在学校体育中的作用;能够有效转移体育风险,从而保障学校体育的开展,促进中小学生的体质健康;能够促进体育保险事业的发展,使我国现有的保险体系更加完善。因此,增设中小学体育保险是必要的。4、我国中小学体育保险增设的政策环境已初步形成;日益成熟的保险业所具备承担高风险的能力;国外相关经验尝试的借鉴;学校、家庭对增设学校体育保险高涨的热情等因素均说明我国目前已具备了增设中小学体育保险的条件。因此,增设中小学体育保险是可行的。
