基于教育管办评分离的中小学依法自主办学的体制机制改革探索

【摘要】：学校依法自主办学意味着学校自主办学的法律主体地位得以确认,学校在法律与制度框架下自主办学权利的实现,学校直接办学责任、教育责任的落实。教育管办评分离改革试点工作启动后,相关省市逐步推行清单管理,适时出台地方教育法律规章,现代学校制度建设持续推进,学校内部治理结构不断完善。但改革仍面临挑战,须建立与完善基于学校章程的学校多元治理机制,保障学校权力的有效运用,促进学校自主发展;建立与完善多元参与的学校事务监督、评价与问责制度,加强学校依法自主办学过程中的事中、事后监管;建立与完善学校法律顾问制度与法律救济制度,支持与保障学校依法自主办学权益。
[Abstract]:The independent running of school according to law means that the legal subject status of independent school running is confirmed. Under the framework of law and system, the realization of the right to run a school independently, the responsibility of running a school directly and the implementation of the responsibility of education. After the start of the reform, the relevant provinces and cities gradually carried out the list management, issued local education laws and regulations in good time, continued to promote the construction of modern school system, and the internal governance structure of the school was constantly improved. However, the reform is still facing challenges. It is necessary to establish and improve the school multi-governance mechanism based on the school constitution, to ensure the effective use of school power, to promote the independent development of the school, to establish and improve the multi-element school affairs supervision, evaluation and accountability system. In the process of school running according to law, we should strengthen the supervision afterwards, establish and perfect the system of school legal consultant and legal remedy, and support and guarantee the rights and interests of the school in accordance with the law.
