我国台湾地区在家上学合法化之后的经验与启示

【摘要】：在多方力量的努力下,我国台湾地区"在家上学"已经取得合法地位。尽管政府早已在立法层面肯定了"在家上学",且有一系列的申请、审批和考核机制,但在实施的过程中依然存在争议,其根本原因在于政府教育权、家长教育选择权和学生受教权三者之间的边界十分模糊。我国台湾地区将在家上学合法化及随之而来的问题启示我们应该确立"在家上学"的法律地位,制定细化可行的实施方案,并且明确权利的边界。
[Abstract]:Thanks to the efforts of various forces, the Taiwan area of China has achieved a legal status of "homeschooling". Although the government has already affirmed "homeschooling" at the legislative level, it has a series of applications, approval and assessment mechanisms. However, there are still disputes in the process of implementation, the root cause of which lies in the government's right to education. The boundary between parents' right to choose education and students' right to receive education is very vague. In Taiwan, the legalization of homeschooling and the problems that come with it suggest that we should establish the legal status of homeschooling. Develop detailed and feasible implementation plans and define the boundaries of rights.
