我国“在家上学”的合法性探讨及规范管理研究

【摘要】:在家上学作为一种异于传统学校教育的形式起源于19世纪末的美国,并以其独特的生命力被迅速推广到其他许多国家和地区。随着社会的发展、个体意识的觉醒以及传统学校教育弊端的日益显现,在家上学在我国开始出现,并且凭借它在弥补学校教育弊端、突显家庭教育功能以及实现个体个性自由发展方面的优势吸引了越来越多的关注者与实践者。在我国处于萌芽探索阶段的在家上学需要社会基于对其深入认识的基础上给予接纳,而在家上学的合法性身份以及规范化发展则是获得这种接纳的关键。本研究试图通过对正在实践在家上学这一教育形式的群体进行访谈以呈现在家上学在我国发展的基本现状,再通过理论与实践的结合,完成对在家上学合法性身份的探讨以及规范化发展路径的探索。全文共分为五个部分。第一章绪论部分主要阐明研究的缘由、现状和意义,对“在家上学”和“合法性”这两个关键概念做出界定,并对所采用的的研究方法做出说明。第二章立足于个案访谈资料,对我国在家上学的实施状况进行呈现,包括在家上学的家庭特征、师资力量、课程设置、组织管理以及主要面临的困境。对在家上学的现实发展状况的分析一方面利于公众对于这一教育形式的更深入了解,另一方面则反映出其发展过程中亟需解决的词题,即合法性和规范化问题。因此,第三章和第四章重点对在家上学的合法性进行分析。其中,前者基于法理层面,后者基于价值层面,这种对法理与价值的双重关注也是本文对合法性诠释的创新性视角。第五章重点从法律制度、管理行为以及社会支持系统入手,探索在家上学规范化发展路径,这是证成在家上学合法性后的必然追求。
[Abstract]:Homeschooling, as a form of education different from the traditional school, originated in the United States in late 19th century and was rapidly extended to many other countries and regions with its unique vitality. With the awakening of individual consciousness and the increasing malpractice of traditional school education, homeschooling is beginning to appear in our country, and it is making up for the disadvantages of school education. The advantages of family education and the realization of individual individual free development attract more and more attention and practitioners. Homeschooling in our country, which is in the embryonic stage of exploration, needs to be based on the deep understanding of homeschooling. On the basis of acceptance, The legitimacy of homeschooling and the standardized development of homeschooling are the keys to this acceptance. This study attempts to present the basic status quo of homeschooling in China by interviewing groups that are practicing homeschooling as an educational form. Then through the combination of theory and practice, the thesis completes the exploration of the legitimacy identity of homeschooling and the exploration of the standardized development path. The full text is divided into five parts. The first chapter introduces the reason, current situation and significance of the research. This paper defines the two key concepts of "homeschooling" and "legality", and explains the research methods used. Chapter two, based on the case interview data, presents the implementation of homeschooling in China. Including the family characteristics of homeschooling, faculty, curriculum, organization and management, as well as the main difficulties faced. The analysis of the actual development of homeschooling helps the public to have a better understanding of this form of education. On the other hand, it reflects the problem of legality and standardization that need to be solved in the course of its development. Therefore, chapter III and chapter 4th focus on the analysis of the legitimacy of homeschooling. The latter is based on the value level, and this dual focus on legal theory and value is also the innovative perspective of the interpretation of legitimacy in this paper. Chapter 5th focuses on legal system, management behavior and social support system. Exploring the standardized development path of homeschooling is the inevitable pursuit after proving the legitimacy of homeschooling.
