《残疾人权利公约》与中国残疾人融合教育的发展——《残疾人教育条例》解读

【摘要】：残疾和残疾人问题,一直以来都是国际社会普遍关注的重要议题。二战后,残疾人运动发展到了一个新高度,并最终于2008年由联合国制定了《残疾人权利公约》。《残疾人权利公约》从法律上正式确认了世界残疾人运动的成果,实现了国际社会在解决残障人士问题上从"医学模式"到"社会模式"的转换,强调将残疾人作为权利主体加以看待。《残疾人权利公约》第24条规定了包容性教育的新理念,明确了残疾人享有参与普通教育、融入社区、接受终身教育等权利并规定了缔约国必须提供合理配置的义务。本文重点分析了修订后的《残疾人教育条例》在贯彻和落实《残疾人权利公约》方面取得的进步。《残疾人教育条例》取消了与《残疾人权利公约》不一致的条文,树立了融合教育的新理念,强调了各级政府在实现融合教育方面的责任,比较合理地平衡了特殊教育学校和融合教育的关系,规定了对侵犯残疾人教育权利的救济措施,从而为细化和完善中国残疾人教育法律体系,促进全社会树立融合观念奠定了坚实基础。
[Abstract]:Disability and disability have always been an important issue of general concern to the international community. After World War II, the movement of persons with disabilities developed to a new level, and finally formulated the Convention on the Rights of Persons with Disabilities by the United Nations in 2008. The Convention on the Rights of Persons with Disabilities formally confirmed the achievements of the world movement for persons with disabilities in law, and realized the transformation of the international community from "medical model" to "social model" in solving the problem of persons with disabilities. Article 24 of the Convention on the Rights of Persons with Disabilities provides a new concept of inclusive education, defines the rights of persons with disabilities to participate in general education, integrate into the community, receive lifelong education, and stipulates the obligation of States parties to provide reasonable allocation. This paper focuses on the analysis of the progress made in the implementation and implementation of the revised regulations on the Education of Persons with Disabilities in the implementation and implementation of the Convention on the Rights of Persons with Disabilities. The regulations on the Education of Persons with Disabilities eliminate provisions inconsistent with the Convention on the Rights of Persons with Disabilities, establish a new concept of integrated education, emphasize the responsibilities of governments at all levels in realizing integrated education, and reasonably balance the relationship between special education schools and integrated education. The relief measures for violating the educational rights of the disabled have been stipulated, thus laying a solid foundation for refining and perfecting the legal system of the education of the disabled in China and promoting the whole society to establish the concept of integration.
