高校教育管理法律纠纷分析及其预防

【摘要】：高校教育管理法律纠纷具有频发性。大学生意外伤害事故、纪律处分事件、学籍管理规定以及其他日常事务管理等问题都可能引发法律纠纷。法律纠纷的产生既有高校管理法治传统相对缺失、程序正当要求难以深入落实等原因,又与管理者法治素养比较薄弱、申诉制度建设相对滞后等密切相关。预防高校教育管理中的法律纠纷,高校可以从提升学校管理制度合法性、加强高校与学生之间的良性互动、促进工作程序化、培育工作人员法治意识以及健全学生申诉制度等方面着手。
[Abstract]:University education management legal disputes are frequent. College students accidental injury incidents, disciplinary incidents. The rules of student status management and other issues such as daily affairs management may lead to legal disputes. The legal disputes are caused by the relative absence of the tradition of the rule of law in colleges and universities, and the difficulty of carrying out the legitimate requirements of the procedures in depth and so on. It is closely related to the weak quality of the rule of law and the lagging of the construction of the appeal system. In order to prevent the legal disputes in the management of higher education, colleges and universities can enhance the legitimacy of the school management system. Strengthen the benign interaction between the university and the students, promote the procedure of work, cultivate the staff awareness of the rule of law, and improve the student appeal system and so on.
