走向实践智慧--法学教育改革的基本原则

【摘要】：当代中国法学教育面临困境,这与人们对"法是什么"的追问与回答密切相关,对"法是什么"的认知会影响和构造法学教育的模式。将法作为阶级斗争的工具去看待,造就了"政治模式"的法学教育;将法归结为规则的认知,导致了"规则模式"的法学教育;而将法看做实践智慧,将会引发法学教育模式的根本变革。走向实践智慧,乃是中国法学教育改革的基本原则。依据法作为实践智慧的基本判定,则法学教育的改革可以表现为三个方面的基本进路:法学教育的人文取向;法学教育的经验维度;法学教育的道德之维。
[Abstract]:The legal education in contemporary China is faced with difficulties, which is closely related to people's questioning and answering of "what is law". The cognition of "what is law" will influence and construct the mode of law education. The cognition of law as rule leads to the law education of "rule mode"; To regard law as practical wisdom will lead to a fundamental change in the mode of legal education. To move to practical wisdom is the basic principle of the reform of legal education in China, and the basis of law as the basic judgment of practical wisdom. Then the reform of legal education can be manifested as three basic approaches: the humanistic orientation of legal education; The empirical dimension of legal education; The moral dimension of legal education.
