依法治国视域中高校“思政课”的法制教育研究

【摘要】:改革开放以来,党和国家的领导人始终高度重视青年学生的法制教育。与此同时,我国法治化进程不断加快,高校的法制教育也取得了前所未有的成绩。然而,全面推进依法治国的时代要求,又赋予了高校以思想政治理论课(下文简称“思政课”)为主渠道、主阵地的法制教育以新的使命。习近平总书记在2014年中国共产党第十八次全国代表大会第四次会议上提出,要全面推进依法治国,建设社会主义法治国家。这使高校“思政课”进一步完善和加强法制教育成为十分紧迫的任务。一般而言,法制教育即以法律制度、法律法规为主要内容的教育教学活动。全面依法治国则要求高校法制教育不仅要重视法律、法规的知识性教育,更要重视对大学生的法理教育和法制意识、法治精神、法制行为的培育。因此,如何将全面推进“依法治国”的新精神、新要求贯彻到教学中,严格按照“进教材,进课堂,进头脑”的“三进”要求进一步完善和加强法制教育,提升“思政课”法制教育的实效性,成为深化“思政课”教学改革、提升“思政课”内涵质量建设的重要课题。对此,本文主要研究了以下四方面内容:一是依法治国的概念及主要理论,阐明依法治国在高校人才培养中的地位和作用。二是从当前“思政课”法制教育的现实出发,提出了当前“思政课”法制教育完善的必要性和紧迫性,分析存在的主要问题:法制教育的主体性问题;法制教育方法的改进问题;法制教育内容适度调整等。这些问题的成因是多方面的,在主观上,既与师生对待依法治国、法制教育的主观态度有关,又与学生对依法治国、法制教育的价值认同内在相联。在客观上,法制教育的课程渗透不够,师资队伍专业化程度不高是主要原因。三是就高校“思政课”的法制教育的多角关系进一步分析法制教育多方面渗透的途径,重点探讨了法制教育与道德教育、法制教育与思想教育等关系,提出了拓展高校法制教育的思路。四是提出并论证完善“思政课”法制教育体系几点建议,如加强法制教育的顶层设计,加强课程体系、教学体系、考核体系的一体化建设等。本文充分肯定了改革开放以来高校法制化教育所取得的重要成果,根据依法治国的新要求,对高校“思政课”的法制教育进行了重要分析,在肯定成效的基础上指出了有待完善的几方面内容,提出了以顶层设计理论指导“思政课”法制教学体系完善和促进师生观念转变,加强多课程相互渗透,创新综合考核体系等建议。在全面推进依法治国的视域中,为“思政课”法制教育更好地服务于现代法治国家的人才培养提供理论参考。

At the same time, the process of rule of law in China is accelerating, legal education in Colleges and universities has hitherto unknown results. Therefore, this paper mainly studies the following four aspects: one is the concept of the rule of law and the main theory of rule of law, clarify the status and role in talents training. The two is starting from the current ideological and political course of legal education reality, put forward the current ideological and political course of legal education the necessity for good and tight The urgency, analyze the main problems: the problem of subjectivity of legal education; improvement of the methods of legal education; legal education content of modest adjustments. The causes of these problems are many, subjectively, both teachers and students towards the rule of law, the subjective state of legal education, and students of the rule of law recognition of the intrinsic value, associated legal education. In fact, the legal education curriculum of teachers is not enough, not high degree of specialization is the main reason. The three is the University Ideological and political course of the legal education of the multi angle relation further analysis of legal education on the osmotic way, focusing on legal education and the relationship between legal education and moral education, ideological education, puts forward the development of university legal education ideas. The four is proposed and demonstrated to improve the ideological and political course system of legal education suggestions, such as strengthening the legal education of the top Layer design, strengthen the curriculum system, teaching system, appraisal system integration. This paper fully affirmed the important achievements of university legal education since the reform and opening up, according to the new requirements of the rule of law, the ideological and political course in university legal education are important in the analysis, based on the effectiveness of the said the contents of several aspects to be perfect, put forward to guide the top-level design theory of Ideological and political course teaching system and improve the legal system to promote teacher-student concept, strengthen the course of mutual penetration, innovation of comprehensive evaluation system and so on. In advancing the rule of law in the perspective of culture, and provide a theoretical reference for the ideological and political course of legal education to better serve the modern country under the rule of law talents.
