日本司法考试与法学教育的耦合关系及启示

【摘要】：日本司法考试与法学教育起源于明治维新,经历初创、确立、变革等不同阶段。而两者的关系若即若离,既有井水不犯河水的时期,也有十分亲密的时代。2001年6月12日发布的《日本司法改革审议会意见书——支撑21世纪日本的司法制度》作为新一轮司法改革的风向标,在革新法学教育方面推行"法科大学院",企图营造法学教育与司法考试的"蜜月关系",只是实践的结果有违初衷。日本改革法学教育和司法考试的诸多得失,对如何协调和处理我国法学教育与国家统一法律职业资格考试的关系有着一定的启示和可资借鉴之处。
[Abstract]:Japanese judicial examination and law education originated from the Meiji Restoration, experienced different stages of establishment, establishment and reform. And if the relationship between the two is so distant, there is a period in which the well water does not intrude on the river, There are also very close times. On June 12, 2001, the opinion of Japan's Judicial Reform Review Conference-supporting Japan's judicial system in the 21st century-served as a bellwether for a new round of judicial reform. In the aspect of innovating the law education, the institute of law science and technology is carried out in an attempt to create the honeymoon relationship between the law education and the judicial examination, but the result of practice is contrary to the original intention. The reform of law education and judicial examination in Japan has some implications for how to coordinate and deal with the relationship between China's legal education and the national unified legal professional qualification examination.
