日本大学教授学术权利的制度保障

【摘要】:大学教授是社会中一个特殊的群体。他们在社会中扮演着知识文明的传播者与探索者,以及社会发展之路的反省者与开拓者。这些身份角色不仅是大学教授内心自我实现的方向,也是外部社会对于教授群体的期许和愿望。每一种角色的设定都有相应的权利义务关系和行为规范体系与之配套,大学教授也不例外。学术权利就是大学教授的权利义务体系中非常重要的一个内容。良好的学术权利保障会成为大学教授实现自身价值、达成社会期许的路途上的强劲助力。由此看来,教授的学术权利的保障问题,不仅仅关乎教授个人的利益得失,还影响到教育科研的盛衰以及社会发展的进退。日本作为我国的近邻,其长久以来文化底蕴深受我国影响,"大学"与"教授"对于中日两国而言,都是舶来之物。现代学术自由与大学自治一脉相承,随着大学与教授也被移植到了东方。同样面对这些舶来品,日本与中国所选择的道路却不尽相同。研究日本教授学术权利的保障方式,评判功过是非,对于我国自身学术权利保障的发展很有借鉴的意义。本文以日本大学教授的学术权利保障为研究对象,从教授群体入手逐渐深入,研究日本教授的身份性质、发展历史、学术权利保障的变迁以及当代学术权利保障体制和现实救济问题。第一章主要是对教授群体的相关背景的梳理。先通过社会学理论,对大学教授的概念、身份特征以及性质特点进行论述。再通过对日本大学教育历史的研究,梳理出日本教授的发展形成脉络。这些背景知识的介绍对下文论述日本教授学术权利起到铺垫作用。第二章主要论述二战以前日本的学术权利萌芽期的情况。了解这一时期的学术权利,就可以了解学术权利在日本这片土地上发展壮大的起点,就可以更好地理解日本教授学术权利后来所发生的种种变化。第三章是对日本战后的学术权利保障的论述。战后日本的秩序是经历对今时往日反省与深思后重建而成,有着比较成熟的理念和经验支持。这一时期学术权利地得到极大的重视,也形成了比较完善的保障体制。不过再良善的体制也会存在弊端,在经过几十年的繁荣后,这种体制也走向衰落。研究这一时期的学术权利保障的优点与弊病,对我国很有借鉴意义。第四章主要是对当代日本教授学术权利保障体制的考察与分析。通过法律规范、教授身份体制以及大学治理体制等角度全面考察日本当代保障状况。并且通过对实践中的具体案例的研究,分析保障体制运行状况以及存在的问题。
[Abstract]:University professors are a special group in society. They act as communicators and explorers of knowledge civilization, as well as reviewers and pioneers of the road of social development. These roles are not only the direction of the inner self-realization of the university professors, but also the expectations and wishes of the external society for the professors. Each role has corresponding rights and obligations relationship and behavior regulation system, and university professors are no exception. Academic right is a very important content in the system of university professor's rights and obligations. A good guarantee of academic rights will be a powerful force for university professors to realize their own values and achieve social expectations. Therefore, the protection of the academic rights of professors is not only related to the personal interests of professors, but also to the ups and downs of educational and scientific research and the progress and decline of social development. Japan, as a close neighbor of our country, has long been influenced by its culture. For both China and Japan, "University" and "Professor" are foreign things. Modern academic freedom is inherited from university autonomy, as universities and professors are transplanted to the East. In the face of these foreign products, Japan and China have chosen a different path. The research on the ways of protecting the academic rights of Japanese professors and judging the merits and wrongs is of great significance for the development of the protection of academic rights in our country. This article takes the academic rights protection of Japanese university professors as the research object, starts with the group of professors, and studies the identity nature and development history of Japanese professors. The vicissitudes of academic rights guarantee, the contemporary academic rights guarantee system and the realistic relief problems. The first chapter is mainly about the background of the group of professors. Firstly, through the sociological theory, this paper discusses the concept, identity and nature of the university professor. Then through the study of the history of Japanese university education, the development of Japanese professors is sorted out. The introduction of these background knowledge plays a role in laying the groundwork for the following discussion of the academic rights of Japanese professors. The second chapter mainly discusses the initiation of Japanese academic rights before World War II. If we understand the academic rights in this period, we can understand the starting point of the development of academic rights in this land of Japan, and then we can better understand the changes that have taken place in the academic rights of Japanese professors. The third chapter discusses the protection of Japan's academic rights after the war. After World War II, Japan's order was reconstructed after reflection and reflection on the past, and it has mature ideas and experience support. In this period, academic rights have been attached great importance to, and formed a relatively perfect guarantee system. However, the good system will also have drawbacks, after decades of prosperity, the system is also declining. The study of the advantages and disadvantages of academic rights protection in this period is of great significance to our country. The fourth chapter is mainly to the contemporary Japanese professor academic rights protection system investigation and analysis. Through the legal norms, professor identity system and university governance system, a comprehensive survey of the contemporary security situation in Japan. And through the study of the specific cases in practice, the operation of the guarantee system and the existing problems are analyzed.
