低龄触法未成年人教育矫正研究

【摘要】:2009年以来我国未成年人犯罪数量得到了有效遏制,但未成年人犯罪低龄化的形势却日趋严峻。在传统的未成年人刑事司法研究范式中,由于低龄触法未成年人对任何犯罪行为均不承担刑事责任,所以不在刑事司法的研究范围内。在少年司法研究范式中,对于未成年人犯罪行为的研究继承了未成年人刑事司法研究范式中的观点,对于未成年人不良行为的研究则集中在14岁以上的年龄范围,我国低龄触法未成年人的教育矫正问题处于研究的起步期。在矫正实际操作方面,由于法律的修订和矫正机构的改革,我国原有的“工读学校-收容教养-未成年人管教所”的矫正模式在矫正低龄触法未成年人方面已趋于崩坏,低龄触法未成年人的矫正实践处于制度的空白阶段。本文围绕低龄触法未成年人这一特定群体,基于多元化开放性的教育矫正视域,进行系统的理论分析,探讨低龄触法未成年人的教育矫正策略与路径。低龄触法未成年人的教育矫正问题,是一个多学科综合的研究问题。需要打破学科的藩篱,从多元化的大教育视域出发,立足教育矫正的终极关怀,探究对低龄触法未成年人的教育矫正的价值预设、价值承诺和定位问题等。以此为理据,展开对低龄触法未成年人教育矫正价值本体探究,确立幸福成长作为教育矫正的价值本体。从价值定位的本体性承诺出发,在对低龄未成年人触法原因进行定量分析的基础上,进一步探究对低龄触法未成年人实施教育矫正的策略及途径问题,从而达到心灵转向的教育矫正目的。第一章对低龄触法未成年人矫正的历史发展和现状进行梳理。儿童概念的认知、刑事实证学派的教育刑思想被广泛认可,为少年司法奠定了理论基础。通过文献研究的方法,总结了少年司法制度的特点和现行的少年司法分类,并分析了我国对于低龄触法未成年人的认知与矫正方法的发展过程,从中了解目前我国低龄触法未成年人矫正中存在的问题。第二章对低龄触法未成年人教育矫正进行理论探讨。通过分析低龄未成年人活动场所、认知的特征,了解低龄未成年人的特殊性。借鉴社会失范理论、差异接触理论和社会纽带理论对于犯罪行为的研究及原因揭示,为探析低龄触法未成人的教育矫正问题提供了分析和研究犯罪问题的认识论和方法论以及可资借鉴的思想观点。从教育矫正的终极关怀出发,展开对低龄触法未成年人教育矫正价值的本体探究,提出幸福成长为教育矫正价值本体的观点。第三章以低龄触法未成年人为研究对象,运用青少年生活满意度量表、情绪体验量表为数据收集工具,探究低龄触法未成年人的触法原因。主要结论如下:主观幸福感与低龄未成年人触法行为呈负相关。其中,情绪体验中,积极情感与低龄未成年人触法行为的发生几率成负相关,而消极情感与低龄未成年人触法行为的发生几率成正相关。与生活满意度总评分与低龄未成年人触法行为的发生呈负相关。生活满意度的六个维度中,友谊和自由满意度与低龄未成年人触法行为的发生呈正相关;家庭、学校、学习和环境满意度低龄未成年人触法行为的发生呈负相关。生活满意度对低龄未成年人触法行为有预测作用,构建Logistic回归模型:logist (P) =13. 025+0. 47 X友谊满意度-0. 44 X家庭满意度-0. 374 X学业满意度+0. 256X自由满意度-0. 290X学校满意度-0. 265X环境满意度。第四章分别从法治教育、传统文化、人格完善、生态协调四个方面,探讨了触法低龄少年的教育矫正策略。一是从突破学校法治教育瓶颈、养成法律意识、强化公民意识、建立法律信仰四个方面,探讨了基于法治教育的法治策略;二是从德主刑辅、道德自律、德行自觉三个方面,探讨了基于传统文化的德治策略;三是从“养心”、“育心”、“化心”、“正心”四个方面,探讨了基于人格完善的心治策略;四是从优化以家庭为核心的微系统教养策略、深化以学校教育为重点的融合互动策略、净化社会教育的网络媒体引导策略三个方面,探讨了基于教育矫正生态结构的综治策略。这四个方面共同构成了具有系统性与逻辑性的教育矫正策略方案与内容体系。第五章是对低龄触法未成年人教育矫正路径探析。首先从虞犯制视域进行教育矫正的路径探析,对虞犯制度与我国《预防未成年人犯罪法》的内涵与矫正方式进行比较分析,从建立拥有“先决权”的裁判机构、扩大社会调查的范围、完善转向处置制度、改革工读教育四个方面,提出了完善教育矫正机制的路径。其次是从“仁爱”、“正义”、“克己”、“诚信”四个方面,分析了教育矫正的主题性路向选择。三是从抓早抓小的规则教育、公权介入的家庭监护、全程一贯的法治教育、有针对性的特色教育、以低龄触法未成年人为主体的自我教育等方面,探讨了教育矫正的过程性路径拓展。四是围绕低龄触法未成年人的幸福成长推进价值建设,从重塑教育矫正价值的本体论担当、促进低龄触法未成年人幸福观的转型建构、提升教育者的幸福感知和幸福观、营造有利于低龄触法未成年人成长的教育环境和心理环境四个方面,探讨了低龄触法未成年人教育矫正的价值本体回归之路。
[Abstract]:Since 2009, the number of juvenile delinquency in China has been effectively checked, but the situation of juvenile delinquency is becoming more and more severe. In the traditional juvenile criminal justice research paradigm, the juvenile delinquency is not responsible for any criminal act, so it is not within the scope of criminal justice. In the annual judicial research paradigm, the study of juvenile delinquency has inherited the view of the juvenile criminal judicial research paradigm. The research on the bad behavior of minors is concentrated in the age range over 14 years old. The education correction questions of the juvenile delinquency juveniles in China are at the beginning of the study. On the other hand, due to the revision of the law and the reform of the correctional institutions, the original correction mode of "the work reading school - the rearing rearing and the minor Management Institute" has tended to collapse in the correction of the juvenile touch law minors, and the correction practice of the juvenile touch law minors is in the blank stage of the system. A specific group, based on the pluralistic and open educational correction horizon, carries out a systematic theoretical analysis to discuss the strategies and paths for the education and correction of juvenile touch law minors. The problem of the education and correction of junior touch minors is a multi-disciplinary research problem. On the basis of the ultimate concern of educational correction, this paper probes into the value presupposition, value commitment and positioning of the juvenile touch law minors, and probes into the noumenon of value noumenon for the education and correction of the juvenile touch law minors, and establishes the happy growth as the value noumenon of the education correction. On the basis of quantitative analysis of the reasons for the touch of law of low age minors, this paper further explores the strategies and ways of implementing education correction for juvenile touch law minors, so as to achieve the purpose of educational correction for the mind turn. The total score of life satisfaction is negatively correlated with the occurrence of contact behavior in low age minors. In the six dimensions of life satisfaction, friendship and freedom are satisfied. There was a positive correlation between the degree and the incidence of legal behavior of young minors; family, school, learning and environmental satisfaction were negatively related to the occurrence of legal behavior.
