教师惩戒行为的刑事可罚性探究

【摘要】：刑事可罚性是判断教师惩戒行为犯罪与否的重要标准。一般而言,教师惩戒行为可能被认定为法令行为、被害人承诺或者正当业务行为而排除其刑事可罚性。其中,法令行为中的"权利行为"强调教师的职业与专业特性,更符合教师惩戒行为的正当化要求。教师惩戒行为的正当化依据主要有目的说、法益衡量说和社会相当性说。相较之,"社会相当性说"注重对学生权利的保护和教育秩序的追求,更具包容性和实用性。教师惩戒行为的正当化构成需要满足"指向学生特定的偏差行为"、"主体是从事教育、管理的教师"、"以教育学生为目的"、"遵守教育法律法规"、"不能超出必要限度"五个要件,反之则有入罪之可能。
[Abstract]:Criminal punishability is an important criterion to judge whether a teacher's disciplinary behavior is a crime or not. Generally speaking, the disciplinary behavior of teachers may be regarded as a statutory act, the victim promises or legitimate professional conduct and excludes its criminal punishability. Among them, the "right behavior" in the act emphasizes the professional and professional characteristics of teachers, which is more in line with the legitimate requirements of teachers' disciplinary behavior. The justification of teacher's disciplinary behavior is mainly based on the purpose, the theory of legal interest measurement and the theory of social appropriateness. Compared with the theory of social appropriateness, it emphasizes the protection of students' rights and the pursuit of educational order, which is more inclusive and practical. The proper constitution of teacher's disciplinary behavior needs to meet the needs of "pointing to the students' specific deviating behavior", "the subject being the teacher engaged in education and management", "aiming at educating students" and "abiding by educational laws and regulations". "must not exceed the necessary limit" five elements, vice versa, it is possible to commit a crime.
