【摘要】:依法治校,就是在当前加强高校管理中,依照宪法和法律特别是用教育的法律法规来管理学校各项事务。依法治校的内涵是高等学校的办学权应当符合法律规定,超越法定的办学权限,其行为为不合法,属于无效行为;高等学校的办学权必须依法行使,否则为无效行为。 本文除引言外,共包括三部分内容。 论文第一部分为依法治校与大学生权益保护概述。主要论述了依法治校的理论基础与现实意义,以及大学生权益保护提出的背景及其特殊性。实施依法治校,有利于为大学生成才做好保障;有利于我们积极实施依法治校的方略,加强和谐校园的建设;有利于推进民主进程,维护学校的教育教学秩序,有利学校、教师、学生三者的协调沟通,保护学生的正当权益不受侵害。由此可见,大学生权益保护提出有其时代背景及其特殊性,依法治校与大学生权益保护有其内在契合性。 论文第二部分主要论述了依法治校进程中大学生权益保护不力的具体表现及原因。依法治校进程中大学生权益保护不力,主要表现为制度建设不够健全、学校的管理制度与法律法规相抵触、学生处理程序没有引起充分重视、处分实施存在过罚不当等表现。此外,在学生申诉方面也存在一些问题。究其原因,主要是在现阶段一些管理行为无章可循,学校制定的部分管理制度与法律法规不一致。在现实的管理实践中,学生处理程序没有引起充分重视。从学生管理实践来看,一些学校对正当程序问题重视不够,在实际操作过程中,没有做到规范化操作,从而导致在诉讼中往往要承担不利的法律后果。处分实施不符合过罚相当的要求。在处分实施过程中,没有做到定性准确、过罚相当,学生申诉的受理机构及法律责任的不明、学生申诉制度部分程序规范的缺失、申诉后救济渠道的封闭;在解决学校与学生之间行政法律纠纷的实践中,学生往往难以用行政诉讼来维护自身的权益,学生申诉成了封闭性、终结性的救济制度。 论文研究的第三部分是推进依法治校进程,加强大学生权益保护的实施策略。在具体策略的实施上,推进大学生权益保护,就要注意转变权益观念,增强大学生的维权意识。为此要教育大学生养成正确的权益观,正确认识合法原则、合理原则、最优选择原则。大学生维权过程中要注意提高自身的维护权益意识,增强自我维权能力。为了维护好自身的权益,,大学生要学习、了解基本法律知识,做到正确行使权利,依法履行义务。学校要注意坚持依法治校管理学生,进一步明确学校的义务,促进学生在品德、智力、体质等方面全面发展。提高教师的思想政治觉悟和教育教学业务水平,使其依法制订规章制度,依法管理学生,正确处理法治方式与其它教育方式的关系,正确处理法治与德治的关系,依法行政、规范管理,完善高校内部各项规章制度。要注意加强校园法制建设,依法维护学校合法权益,进一步完善依法决策机制,加强民主管理和民主监督,积极开展法制教育活动,提高师生法律素质。要注意健全、完善学生申诉制度,设立各级申诉委员会并明确其法律责任,完善学生申诉制度的程序规范,拓宽学生申诉后的救济渠道。要注意建立教育仲裁制度,在具体实施中,把握好强制性仲裁原则、先行调解原则、一裁终局原则、仲裁者不被起诉原则、程序正义原则等教育行政仲裁的原则。做好教育行政仲裁委员会的设立,完善好教育行政仲裁的程序。要注意发挥大学生在权益保障中的自身作用。为此,应建立大学生民主管理制度,做到正确培养引导大学生的民主意识及参与能力,在“以学生为本”的基础上建立起民主管理维权和科学管理体系,做到科学规范、“四权”并举,积极探索拓展民主管理的新途径。同时要积极提高大学生自我保护意识,减少大学生权益受侵害的可能。通过教育,使大学生提高自觉防范意识,促进个人全面发展。通过依法治校改进学校管理,推动社会整体进步。
[Abstract]:The rule of law, is to strengthen the management of current, in accordance with the Constitution and laws especially the use of educational laws and regulations to manage the affairs of the school. The law school is the connotation of higher education rights should conform to the legal provisions, beyond the statutory school authority, its behavior is not legitimate, belong to invalid behavior; higher education right must be exercised in accordance with the law, otherwise invalid behavior.
In addition to the introduction, this article includes three parts.
The first part of the thesis for the rule of law and the protection of the rights and interests of college students. This paper mainly discusses the theoretical foundation and practical significance of the rule of law, and the protection of students' rights put forward the background and particularity. The implementation of the rule of law, beneficial for College students to do security; help us to actively implement the strategy of the rule of law, strengthen the construction of harmonious campus is; to advance the democratic process, and maintain the school teaching order, good schools, teachers, students of the three coordination and communication, and protect the legitimate rights and interests of students are not infringed. Thus, the protection of the rights and interests of university students has its era background and particularity, the rule of law and protection of students' rights has its inherent fit.
The second part mainly discusses the specific manifestations and causes of ineffective protection of students' rights in the process of the rule of law. The rule of law in the process of students' rights protection is ineffective, mainly for the system construction is not perfect, the system contravene the laws and regulations of school management, student treatment program did not cause enough attention, punishment implementation existedpunishments. In addition, the students also exist some problems. The reason is mainly at the present stage, some management behavior of nowhere, schoolmanagement system and laws and regulations are not consistent. In management practice, student treatment program did not cause enough attention. From the student management practice, some schools are not enough pay attention to the due process, in the actual operation process, not standardized operation, resulting in the lawsuit often bear the adverse legal The consequences of sanctions. The implementation does not meet the requirements. A penalty equivalent punishment in the implementation process, did not achieve qualitative accurate, a penalty equivalent, the accepting institution student complaints and the legal liability is unclear, the lack of student appeal system part of the program code, the complaint after the relief channels are closed; in the practice of solving administrative disputes between schools and students it is difficult for students in the use of administrative litigation to protect their own interests, the student complaints closed, the end of the relief system.
The third part of the thesis is to promote the rule of law process, strategy of strengthening the protection of students' rights. In the implementation of specific strategies, promote the protection of students' rights, we should pay attention to change rights concept, enhance the students' awareness of their rights. The education of university students to develop a correct concept of rights, a correct understanding of the legal principle, reasonable principle, optimal selection in the process of college students. The principle of rights should pay attention to improve their awareness of safeguarding the rights and interests, strengthen the self protection ability. In order to safeguard their own interests, college students should learn, understand the basic knowledge of the law, do the right to exercise their rights, fulfill their obligations in accordance with the law. The school should pay attention to adhere to law school student management, to further clarify the obligations of the school, promote the students in moral character, intelligence, physical and other aspects of comprehensive development. To improve teachers' political consciousness and education level of business, make it according to the law. According to regulations, the management of students, correctly handle the relationship between rule of law and other educational means, the relationship between law and morality, correctly handle the administration according to law, standardize management, improve the system of internal rules. Colleges and universities should pay attention to strengthening the campus legal construction, safeguard the legitimate rights and interests of the school, to further improve the decision-making mechanism, strengthen democratic management and democratic supervision, actively carry out legal education activities, improve students' legal quality. Attention should be paid to improve, improve students' appeal system, the establishment of the appeal committee at all levels and a clear legal responsibility, standardize and perfect the procedure of student appeal system, broaden their appeal after the relief channel. We should pay attention to building the education arbitration system, in practice, a good grasp of compulsory arbitration in principle, the principle of mediation, a final ruling principle, arbitrator is not being charged principle, principle of procedural justice, educational administrative arbitration principles do. The establishment of educational administrative arbitration committee, improve educational administrative arbitration procedure. To the attention of the students in the protection of the rights of their own. Therefore, should establish the democratic management system of college students, guide students to correctly cultivate democratic consciousness and ability to participate in the democratic management rights and establish a scientific management system based on "student-centered", achieve scientific standard, "four rights", and actively explore new ways of developing democratic management. At the same time to actively improve the college students' awareness of self-protection, to reduce students' rights may be infringed. Through education, to enable students to raise awareness awareness, promote the all-round development of individuals. The improvement of school management by law, promote the overall social progress.
