关于中国“大学章程”拟定存在的问题——高校学生权利的若干思考

【摘要】：大学章程是一所大学的"宪法",是一校之内具备最高效力的规则。《国家中长期教育改革和发展规划纲要(2010-2020年)》(下简称"《纲要》")颁布以来,尤其是2011年教育部制定了《高等学校章程制定暂行办法》以来,大学章程建设便成为了建设中国特色现代大学的重点内容之一。尽管近年来不少高校在章程拟定方面取得了一定的成果,但学生作为高等学校的构成主体之一,其权利缺乏足够重视的问题依然突出,尤其是受传统教育思维和高校管理现状等诸多因素的影响,有关学生参与学校事务及学生权益保护的章程条款不能得到应有的制定与贯彻。从学生权利在大学章程中的主要体现方面、以及国内外大学章程对此的具体规定等方面出发,结合对中国大学当前普遍存在问题的原因分析,希望探索出中国未来大学章程拟定中能够突显学生权利的路径与方法。
[Abstract]:The charter of a university is the Constitution of a university and is the most effective rule within a university. Since the promulgation of the National Medium- and Long-term Education Reform and Development Program, 2010-2020, (hereinafter referred to as "the outline"), In particular, since the Ministry of Education formulated the interim measures for the formulation of the articles of Association of higher Education in 2011, The construction of university articles of association has become one of the key contents of constructing modern universities with Chinese characteristics. Although in recent years many colleges and universities have made certain achievements in the drafting of regulations, students, as one of the main components of colleges and universities, have become one of the main parts of colleges and universities. The lack of sufficient attention to their rights is still prominent, especially under the influence of many factors, such as the traditional educational thinking and the present situation of university administration, etc. The articles of association concerning the participation of students in school affairs and the protection of students' rights and interests cannot be formulated and carried out properly. From the aspects of the main embodiment of students' rights in the articles of association of the university, and the specific provisions of the statutes of universities at home and abroad, etc., Based on the analysis of the causes of the current problems in Chinese universities, the author hopes to explore the ways and methods that can highlight the rights of students in the drafting of the statutes of Chinese universities in the future.
