大学章程内容要素研究

【摘要】:《国家中长期教育改革和发展规划纲要(2010-2020年)》第十三章明确指出“加强章程建设”,同年,国务院确定以北京大学、北京师范大学等26所高校为试点,推动建立健全大学章程。2011年11月,教育部以第31号令的形式颁布了《高等学校章程制定暂行办法》,2012年1月,教育部决定“2012年推动所有高校全面启动章程制定或修订工作,实现‘政校分开’”。制定大学章程成为中国高校面临的重要任务。基于此,希冀为中国大学章程制定切实可行的章程提供可资借鉴的依据。 遵循“问题提出——文献分析——构建分析框架——分类研究——基本结论——政策建议”归纳式思维线路,按照理想类型法,将大学章程分为盎格鲁—撒克逊传统大学章程和罗马传统大学章程。通过大学章程的学术史考察与典型举要,分别描述了美国、英国、法国、德国、日本和中国大学章程的历史流变与内容构成。盎格鲁—撒克逊传统大学章程的内容特性是:第一,规定学校办学目的、发展目标与主要任务;第二,社会参与的发展决策机制;第三,规定大学内部管理体制和运行机制;第四,规定大学与政府的关系;第五,规定章程的修改主体和程序。罗马传统大学章程的内容特性是:第一,规定政府参与大学治理的优先权;第二,规定大学最高权力机构的运行程序;第三,大学理念、使命的阐述;第四,规定章程的制定、修改主体与程序。 归纳总结,现代大学章程的基本内容包括:第一,确定大学目标,阐述大学使命;第二,大学的组织机构和管理体制;第三,大学的财务、经费管理;第四,大学教职员工的权利与义务;第五,学生的权利与义务;第六,章程的制定、生效与修改。 “他山之石,可以攻玉”。我国近期制定的大学章程与境外大学章程在内容上存在差异,主要表现在:第一,董事会(理事会)领导下的校长负责制;第二教授治校与学术自由;第三,内容安排上差异较大。我国大学章程内容上存在的主要问题是:第一,大学法律地位以及大学与政府、大学与社会的关系尚不明确;第二,内容过于关注原则,对细节规定不足;第三,文字表述不够规范。因此,基于中国大学制定的章程既要体现“中国特色”更要遵循“世界通则”的原则,结合立法以及其他类型章程的制定惯例,提出我国大学章程内容的建议。序言部分应该包括:1.大学的历史及建设成就;2.大学的使命和大学的理想;3.制定大学章程的缘由。总则部分应包括:1.学校名称、校址;2.办学宗旨。正文部分应包括:1.学校标志;2.党委和行政之间的职权;3.校、院管理体制;4.教授治学、学术机构的职权;5.教职员工和学生的权利;6.财务制度;7.师生社会服务与外部关系;8.校友参与。附则部分应包括:1.章程的核准生效及修改;2.章程的解释权。
[Abstract]:Chapter 13 of the National Medium- and Long-Term Education Reform and Development Program (2010-2020) clearly pointed out that "strengthening the construction of the articles of association". In the same year, the State Council decided to take 26 universities such as Peking University and Beijing normal University as its pilot projects. Promoting the establishment and improvement of the university charter. In November 2011, the Ministry of Education promulgated the interim measures for the Establishment of the Charter of higher Education in the form of decree No. 31. In January 2012, the Ministry of Education decided that "in 2012, all institutions of higher learning should be promoted to fully initiate the development or revision of their statutes," To realize the separation of government and school. " It has become an important task for Chinese universities to formulate the university charter. Based on this, we hope to provide a reference basis for the establishment of Chinese university charter. Following the generative thinking line of "problem proposition-literature analysis-construction of analytical framework-classification research-basic conclusions-policy recommendations", according to the ideal type method, The university charter is divided into Anglo-Saxon traditional university charter and Roman traditional university charter. Through the academic history of the university charter and the typical exposition, this paper describes the historical evolution and content constitution of the university charter of the United States, Britain, France, Germany, Japan and China respectively. The contents and characteristics of Anglo-Saxon traditional university charter are as follows: first, the purpose, development goal and main task of the school; second, the decision-making mechanism of social participation; third, the regulation of the internal management system and operation mechanism of the university; Fourth, regulate the relationship between the university and the government; fifthly, stipulate the subject and procedure of the amendment of the constitution. The characteristics of the constitution of the traditional university in Rome are as follows: first, the priority of government participation in university governance; second, the operation procedure of the university's supreme authority; third, the elaboration of the university's concept and mission; and fourth, the formulation of the statute. Modify the subject and procedure. Summing up, the basic contents of the charter of modern university include: first, to define the university objectives and expound the mission of the university; second, the organization and management system of the university; third, the finance and fund management of the university; fourth, The rights and obligations of university staff; fifthly, the rights and obligations of students; and the sixth, the formulation, validity and amendment of articles of association. Therefore, based on the constitution of Chinese universities, we should not only embody the principle of "Chinese characteristics" but also follow the principle of "universal principles", and put forward some suggestions on the contents of the articles of association of Chinese universities in combination with the legislation and other kinds of regulations.
