高校学生社团问题研究

【摘要】:高校学生社团建设由于其所具有的特殊作用在近年来越来越为人们所重视,特别是2004年《中共中央、国务院关于进一步加强和改进大学生思想政治教育的意见》(中发[2004]16号)发布后,对于高校学生社团在高校学生思想政治教育领域内重要作用的认识被提到了一个新的高度。 遗憾的是,我国高校学生社团的研究还处于起步阶段,对于时代发展所带来的各种各样的问题还没有清晰的思路,这一方面是由于我国整体上对于社会团体管理的法律建设和管理手段还不完善,对于社会团体的法律地位、权利义务关系、社团法人界定等方面还存在模糊不清和限定不明的明显问题,另一方面是由于高校学生社团自身所具有的特殊性在很大程度上阻碍了高校学生社团发展过程中自治力与外驱力的有效、适度发挥。因此,对高校学生社团问题进行研究具有重要意义,而其研究现状又不能满足实际需求,这就为本研究提供了有益的契机。基于高校学生社团发展过程中存在的问题,本文从三个方面进行了较为深入的分析。 第一,高校学生社团法律地位探析。在本部分,本文试图对高校学生社团法律地位作出系统梳理,以明确高校学生社团的法律地位,进而对其法定范围内的权利义务关系进行界定。对此有三点结论:一是由于高校学生社团成立于高校内部,因此可以将之视为高校内部成立的,在高校内部活动的学生自治组织,而这类组织按照相关法律规定应当向高校相关部门进行登记、注册和备案,并接受相应的管理,而不需要再向各级政府的民政部门申报、登记和备案;二是高校学生社团从属于高校这一事业单位法人(国内对于这一界定还存在争论),从法律意义上说,其并不能承担相应的法律责任,不具备法人资格;三是高校学生社团虽然并不具备社团法人的资格,但是其本质上仍是由高校学生自愿组成的,以实现会员共同意愿的组织,因此其仍具有自我管理、自我组织的权利,但这一权利的实现应基于其活动遵守法律并按照章程开展的基础之上。据此,我们进一步分析阐释了高等学校与学生、高等学校与高校共青团组织、高校学生社团与高等学校共青团组织之间的关系,为进一步分析奠定基础。 第二,高校学生社团发展过程中的问题分析。在本部分,本文针对已有的研究结果,结合调研数据,系统分析了高校学生社团发展过程中出现的高校学生社团自治力的不足、高校学生社团自治力的扩张、高校学生社团外驱力的缺失、高校学生社团外驱力的内引等显著问题。并对这些问题出现后对高校学生社团发展产生的不良后果进行了分析。一方面,这些问题的出现直接导致了高校学生社团发展的滞后及组织的异化;另一方面,这些问题的出现对于高校学生社团作用的良性发挥产生了阻滞作用。总体看来,高校学生社团发展过程中出现的诸多问题是由多方面因素所导致的,主要表现在四个方面:一是高校学生社团发展过程中的“二力”失衡;二是高校学生社团发展过程中的制度缺失;三是高校学生社团自身的复杂性;四是高校学生社团发展过程中的环境多样性。对于这些问题的清晰认识,有助于我们对于高校学生社团问题的解决提出较为有效的对策。 第三,高校学生社团发展策略分析。本文在已有研究的基础上,结合实际,对于高等学校学生社团发展过程中遇到的问题提出了相应的解决策略。研究主要从高校学生社团的法律地位出发,着手于正确发挥其权利和义务,依据治理理论,以适度、平衡、多维的思维视野,试图在多主体参与、适度参与、多维参与的层面给出高校学生社团发展的合理路径,使高校学生社团发展能够回归合理、适切的轨迹。
[Abstract]:The construction of student associations in Colleges and universities has been paid more and more attention in recent years, especially in the 2004 "the Central Committee of the Communist Party of China, the opinion of the State Council on Further Strengthening and improving the ideological and political education of college students" (No. [2004]16), for college student associations in the field of Ideological and political education in Colleges and universities. The recognition of the important role has been mentioned to a new height.
Unfortunately, the study of college student associations in China is still in its infancy. There is no clear idea about all kinds of problems brought about by the development of the times. This is due to the incomplete legal construction and management methods for the management of social groups in our country, and the legal status of social groups and the relationship of rights and obligations. On the other hand, the particularity of the college student associations hinders the effective and moderate exertion of autonomy and external drive in the course of the development of College Students' associations. Therefore, the research on the problem of college student associations is carried out. It has important significance, and its research status can not meet the actual needs, which provides a useful opportunity for this study. Based on the problems existing in the process of the development of college student associations, this paper has carried out a more in-depth analysis from three aspects.
The first is the legal status of college student associations. In this part, this article tries to make a systematic review of the legal status of college student associations in order to clarify the legal status of college student associations, and then to define the rights and obligations within their legal scope. There are three conclusions: one is that college student associations are established in Colleges and universities. As a result, it can be considered as a student self-governing organization that is established within the universities and within the colleges and universities. In accordance with the relevant laws and regulations, the organizations should register, register and register with the relevant departments of the University, and accept the corresponding management, and do not need to declare, register and record them to the civil affairs departments of the governments at all levels, and two are colleges and universities. From the legal sense, the student association can not bear the corresponding legal responsibility and do not have the legal person qualification. The three is that the college student association does not have the qualification of the Corporation, but it is still made up of the students voluntarily. The organization that realizes the common will of members, therefore, still has the right to self-management and self-organization, but the realization of this right should be based on the basis for its activities to comply with the law and in accordance with the constitution. Accordingly, we further analyze and explain the organization of higher schools and students, the Communist Youth League of higher schools and universities, college student associations and high school students. The relationship between the Communist Youth League organizations and other schools lay the foundation for further analysis.
Second, analysis of the problems in the development of college student associations. In this part, this article, in view of the existing research results, combined with the survey data, systematically analyzes the lack of autonomy of college student associations in the course of the development of college student associations, the expansion of the autonomy of the College students' associations, the lack of the external drive of the college students' associations, and the colleges and universities. On the one hand, the emergence of these problems directly leads to the lag of the development of College Students' associations and the alienation of the organization; on the other hand, the emergence of these problems has the role of the college student association. In general, many problems in the development of college student associations are caused by many factors, mainly in four aspects: one is the "two force" imbalance in the development of college student associations; two is the lack of system in the development of college student associations; three is high. The complexity of the school students' community itself; four is the environmental diversity in the course of the development of college student associations. A clear understanding of these problems will help us to put forward more effective countermeasures for solving the problem of college student associations.
Third, analysis of the development strategy of college student associations. On the basis of the existing research, this paper puts forward corresponding solutions to the problems encountered in the process of the development of college student associations. A reasonable, balanced and multidimensional view of thinking, trying to give a reasonable path to the development of College Students' associations in the aspects of multi subject participation, moderate participation and multidimensional participation, so that the development of college student associations can return to a reasonable and reasonable path.
