高校科研项目知识产权的价值评估研究

【摘要】：二十一世纪是知识经济的时代，伴随着世界经济的不断发展和各国对创造性智力成果权利意识的不断增强，知识产权成为国家财富的象征、经济繁荣的基础，也是综合国力的有效体现。我国在党的十七大报告中明确提出了要实行知识产权战略，审议并通过了《国家知识产权战略纲要》，引导高校和科研院所将知识产权的创新成果向企业转移，努力完善知识产权的价值评估体系。高校因其学科丰富、智力密集而成为国家知识产权战略的主要参与者，，同时还是国家知识产权的最大拥有者。然而在认识到知识产权重要性的同时，高校科研项目所产生的智力成果却很难使其充分发挥作用，究其原因主要是由于对知识产权价值认识的缺乏与不当。知识产权的价值不能进行科学合理的分析与评估，使得国家的权益难以保障，进而影响和制约了高校科研项目所产生的知识产权的推广与应用。为加快我国的现代化建设的步伐，将知识产权应用于实践，首先必须对知识产权定价中存在的问题予以解决并合理定价，以保障国家的权益和促进社会的发展。要实现高校科研项目知识产权的商业化和产业化，贯彻落实国家知识产权战略纲要，首先必须解决的就是价值这一复杂且影响因素众多的难题。目前，国内对知识产权的研究多数是基于管理和制度层面的，对于价值问题的研究相对较少，而以高校科研项目的知识产权价值作为切入点的研究更是少之又少。本文首先分析了研究的背景意义和国内外的研究现状，以及就知识产权的含义、特征和相关的理论基础做了一定程度的论述。在此基础上解析了高校科研项目知识产权投入产出的现状，主要将科研价值和经济价值作为切入点。根据高校科研项目知识产权价值的影响因素，主要有知识产权特征、宏观环境、高校和企业等。分析现有的定价方法成本法、收益法、市场法和实物期权方法在高校科研项目知识产权价值的确定中的应用和适用性。高校科研项目的知识产权主要可以分为可交易知识产权和不可交易知识产权，在价值的确定方法上就不可交易知识产权主要分析了知识产权的科研价值，为应用研究的推广铺平道路。
[Abstract]:The 21 century is the era of knowledge economy. With the continuous development of the world economy and the increasing awareness of the right to creative intellectual achievements, intellectual property rights become the symbol of national wealth and the foundation of economic prosperity. It is also an effective embodiment of comprehensive national strength. In the report of the 17th National Congress of the Communist Party of China, China explicitly proposed the implementation of the intellectual property strategy, deliberated and adopted the outline of the National intellectual property Strategy, and guided universities and scientific research institutes to transfer the innovative achievements of intellectual property to enterprises. We will strive to improve the evaluation system of intellectual property rights. Colleges and universities have become the main participants in the national intellectual property strategy because of their rich discipline and intelligence density, and they are also the largest owners of national intellectual property rights. However, while recognizing the importance of intellectual property rights, it is difficult to make full use of the intellectual achievements of scientific research projects in colleges and universities, which is mainly due to the lack and improper understanding of the value of intellectual property rights. The value of intellectual property can not be scientifically and reasonably analyzed and evaluated, which makes it difficult to guarantee the rights and interests of the country, thus affecting and restricting the promotion and application of intellectual property produced by scientific research projects in colleges and universities. In order to quicken the pace of our country's modernization construction and apply intellectual property to practice, we must first solve the problems existing in the pricing of intellectual property and reasonably price it in order to protect the rights and interests of our country and promote the development of society. In order to realize the commercialization and industrialization of intellectual property rights of scientific research projects in colleges and universities, and to carry out the national intellectual property strategic outline, the first problem that must be solved is the value, which is complex and has a lot of influence factors. At present, most of the domestic research on intellectual property is based on the management and system level, and the research on value is relatively small, and the research on the intellectual property value of scientific research projects in colleges and universities as a starting point is even less. This paper first analyzes the background significance of the research and the current research situation at home and abroad, and discusses the meaning, characteristics and related theoretical basis of intellectual property to a certain extent. On this basis, the paper analyzes the current situation of intellectual property right input and output of scientific research projects in colleges and universities, mainly taking scientific research value and economic value as the starting point. According to the influencing factors of intellectual property value of scientific research projects in colleges and universities, there are mainly intellectual property characteristics, macro environment, universities and enterprises, etc. This paper analyzes the application and applicability of existing pricing methods, such as cost method, income method, market method and real option method, in determining the value of intellectual property rights of scientific research projects in colleges and universities. The intellectual property rights of scientific research projects in colleges and universities can be divided into tradable intellectual property rights and non-tradable intellectual property rights. In terms of the method of determining the value of non-tradable intellectual property rights, the scientific research value of intellectual property rights is mainly analyzed. It paves the way for the popularization of applied research.
