中美大学章程比较研究

【摘要】:在现代大学制度设计不断推进的背景下,作为现代大学制度载体的大学章程日益引起人们的关注和思考,大学章程研究逐渐成为教育理论界的热点课题。同时,大学自主权的落实、大学与政府关系的理顺以及大学内部关系的配置等众多难题的攻克都与大学章程的制定与实施有着密切联系。可见,大学章程研究是摆在高等教育理论工作者面前的一项刻不容缓的课题。大学章程应如何制定?其文本应涉及哪些内容?美国大学章程建设有何优势与经验值得我们借鉴?诸多问题都亟待研究和解决。 本论文以美国为参照,对中美大学章程进行比较研究。研究方法以比较研究和文献研究为主,辅之以历史研究和个案研究。论文首先追溯了中美两国大学章程的发展历程,进而总结出两国在章程建设中的经验与教训;然后,根据大学章程的分析框架,选取中美两国各三所高校作为典型个案,分别对中美大学章程的法律基础、制定机制、文本内容三方面进行考察,系统分析美国大学章程的优势和中国现行相关制度的不足。最后,在此基础上提出推进大学章程建设的可行性建议,为合理借鉴美国大学章程的宝贵经验提供学习路径。 本论文除绪论与结语外共分五个部分: 第一部分为中美大学章程的发展历程比较。从历史的向度对中美两国大学章程的演变进行追溯,试图探寻两国在大学章程发展中的经验与教训。 第二部分为中美大学章程的法律基础比较。将中美两国大学章程的法律性质和法律地位进行对比分析,总结出两国大学章程法律基础的差异。 第三部分为中美大学章程的制定机制比较。分别从制定主体、依据和程序三方面进行论述,进而对两国大学章程制定机制的异同与优劣进行总结。 第四部分为中美大学章程的文本内容比较。对比分析两国当前大学章程的文本内容,总结其各自的特点,通过与美国的比较凸显我国大学章程建设的差距与不足。 第五部分为结论与启示。在前四章对中美大学章程的共性与个性比较分析的基础上,总结出三个基本结论,并结合历史经验教训,从法律基础、制定机制及文本内容三个方面提出加强我国大学章程建设的参考建议。
[Abstract]:Under the background of the continuous development of the modern university system design, the university charter, as the carrier of the modern university system, has attracted more and more attention, and the research of the university charter has gradually become a hot topic in the field of educational theory. At the same time, the implementation of the autonomy of the university, the straightening out of the relationship between the university and the government, and the allocation of the internal relationship between the university and many other difficult problems are closely related to the formulation and implementation of the university charter. It can be seen that the research of university charter is an urgent task in front of higher education theorists. How should the university charter be formulated? What should the text address? What are the advantages and experiences of the constitution construction of American universities? Many problems need to be studied and solved. Based on the reference of the United States, this thesis makes a comparative study of the statutes of Chinese and American universities. The research methods are mainly comparative and literature studies, supplemented by historical studies and case studies. Firstly, the paper traces the development of the charter of China and the United States, and then sums up the experiences and lessons of the two countries in the constitution construction. Then, according to the analysis frame of the university charter, three universities in China and the United States are selected as typical cases. This paper investigates the legal basis, the formulation mechanism and the text content of the statutes of Chinese and American universities, and systematically analyzes the advantages of the statutes of American universities and the shortcomings of the current relevant systems in China. Finally, on the basis of this, the paper puts forward some feasible suggestions to promote the construction of the university charter, and provides the learning path for the reference of the valuable experience of the American university charter. This thesis is divided into five parts except introduction and conclusion. This paper traces the evolution of the university charter of China and the United States from the angle of history, and tries to explore the experiences and lessons of the two countries in the development of the university charter. The second part is the comparison of the legal basis of the statutes of Chinese and American universities. This paper compares the legal nature and legal status of the statutes of Chinese and American universities, and concludes the differences of the legal basis of the statutes between the two countries. The third part is the comparison between Chinese and American university constitution formulation mechanism. This paper discusses the main body, the basis and the procedure respectively, and then summarizes the similarities and differences of the constitution making mechanism between the two countries. The fourth part is the comparison of the contents of the articles of association between China and America. This paper contrasts and analyzes the text content of the current university charter of the two countries, summarizes their respective characteristics, and highlights the gap and deficiency of the university charter construction in our country through the comparison with the United States. The fifth part is the conclusion and enlightenment. On the basis of the comparative analysis of the commonness and individuality of the statutes of Chinese and American universities in the first four chapters, this paper summarizes three basic conclusions, and combines the historical experiences and lessons from the legal basis. The author puts forward some suggestions on how to strengthen the construction of university charter in China from the three aspects of establishment mechanism and text content.
