蔡元培与北京大学法科存废之争

【摘要】:民国新立,在政制急速调整之下,大学学制亦变动不居,反映了国人再造大学迫切而游移不定的心态。1917年,主持北京大学的蔡元培决定停办法科,只保留文、理两科。此举遭致各方强烈反对,甚至激起学潮,并引发一场波及海内外的大讨论。学理与技术能否并存,应注重学理、专事学问,抑或务求实用、经世致用?分科应求全务广、综合共通,还是有所取舍、学术各为建制?这些问题均在讨论之列。究其根源,蔡元培的思想根植于欧洲中世纪以来的大学学术自由价值观,以研究为再造大学之急务,以争取学术自由及"为学问而学问"为旨趣,创生新文化与造成新学风,以引领中国现代社会发展。同时,学术分校也属因应社会纷争策略上的考虑。
[Abstract]:In 1917, Cai Yuanpei, who presided over Peking University, decided to suspend the study of law, retaining only two subjects, namely, the arts and science, as a result of the rapid adjustment of the political system and the change in the academic structure of the university, reflecting the urgent and uncertain mentality of the Chinese people in rebuilding the university. The move was met with strong opposition and even sparked a wave of learning, and triggered a big debate at home and abroad. Can there be co-existence of academic theory and technology, should we pay attention to academic theory, specialize in learning, or try to be practical and practical? Should the division seek a wide range of services, comprehensive and common, or a trade-off, academic institutions? These questions are all under discussion. Looking into the root causes, Cai Yuanpei's thoughts are rooted in the values of academic freedom in universities since the Middle Ages in Europe, the urgent task of rebuilding universities is research, the aim is to strive for academic freedom and "learning for learning", to create a new culture and to create a new style of study. In order to lead the development of modern Chinese society. At the same time, the academic branch also belongs to the strategic consideration of coping with social disputes.
