多中心视角下城市违法建设治理研究

【摘要】：近些年来,我国经济快速发展,城市建设日新月异,城市居民生产生活条件不断改善。但与之不和谐的是,城郊结合部、城市主干道两侧、城市出入口等地违法建设现象屡禁不止。这些现象不仅影响到城市整体形象和市容市貌,破坏人民群众生产生活环境;而且严重危害社会公平,亵渎法律尊严,甚至存在严重的安全隐患,影响到群众生命财产安全,阻碍了经济社会和城市建设的健康有序发展。本文共六部分。第一部分为绪论,主要介绍了本文的选题背景和意义、研究目的、国内外研究现状、创新点以及研究方法等内容。第二部分重点对违法建设等概念进行了明确界定并对多中心治理理论进行了系统阐述。第三部分结合P市城市违法建设治理的现状,分析了违法建设的形成原因和当前主要治理措施。第四部分运用多中心理论,从政府、社会组织、公众等三方面探讨了违法建设存在问题的主要原因。第五部分针对P市违法建设治理的问题提出了相应的解决对策,包括构建政府主导违法建设治理长效机制、完善社会组织监督运行机制以及增强公众参与治理违法建设力度等。第六部分为本文的结论部分。本文运用了实地调研、查阅资料、理论和实践相结合的方法,以所在的P市为例,在对城市违法建设现状和所面临的困境进行分析的基础上,运用奥斯特罗姆夫妇提出的“多中心治理理论”进行综合分析,通过政府、社会组织和公众的多方参与,构建以政府为主导的治理长效机制、完善以社会组织为主的监督运行机制以及不断增强公众参与违法建设治理的意识。力图探求解决违法建设治理的新途径,为我国各地违法建设治理提供一些有益的思路和可参考的建议。
[Abstract]:In recent years, China's economy has developed rapidly, urban construction has been changing with each passing day, and the production and living conditions of urban residents have been continuously improved. The phenomenon of illegal construction in places such as urban entrances and exits is not only prohibited. These phenomena not only affect the overall image of the city and the appearance of the city, destroy the production and living environment of the people, but also seriously endanger social justice and violate the dignity of the law. There are even serious security risks, which affect the safety of life and property of the masses and hinder the healthy and orderly development of economic, social and urban construction. The first part is the introduction, which mainly introduces the background and significance of the topic. Research purpose, domestic and foreign research status, The second part focuses on defining the concept of illegal construction and systematically expounding the theory of multi-center governance. The third part combines with the current situation of illegal construction in P city. This paper analyzes the reasons for the formation of illegal construction and the main measures to govern it at present. Part 4th uses the multi-center theory from the government and social organizations. This paper discusses the main reasons for the problems in illegal construction from three aspects, such as the public. Part 5th puts forward the corresponding solutions to the problem of illegal construction governance in P city, including the establishment of a long-term mechanism for the governance of illegal construction led by the government. The 6th part is the conclusion part of this paper. This paper uses the method of field investigation, consulting information, theory and practice. Taking the city of P as an example, on the basis of analyzing the current situation of the illegal construction of the city and the difficulties it faces, the author makes a comprehensive analysis by using the "multi-center governance theory" put forward by the Ostrom and his wife, and through the government, The participation of social organizations and the public, and the establishment of a long-term governance mechanism led by the government, To improve the supervision and operation mechanism, which is based on social organizations, and to continuously enhance the public's awareness of participating in illegal construction and governance, and to seek new ways to solve the problem of illegal construction governance, To provide some useful ideas and suggestions for illegal construction in various parts of our country.
