博弈论视角下政府购买公共服务的风险防范控制研究

【摘要】：政府购买公共服务是政府为转变政府职能、创新公共服务供给方式、提高公共服务供给水平、提高财政支出效率而推行的一项改革。目前,从中央到地方,从实践探索到制度设计都在大规模的推进,在实践的过程中显现出来的政府购买制度设计的缺陷亟需研究和完善。政府购买公共服务的提出是为了破除政府长期在公共服务供给方面的垄断,提高公共服务的供给水平和供给效率,转变政府职能。近年来,政府购买公共服务的改革在迅速地推进,然而,在实践的过程中也暴露出购买流程不规范、缺乏问责机制以及监督机制不完善以及监督程度较低等诸多潜在风险。因此,构建政府购买公共服务的风险防范机制迫在眉睫。本文从公共产品供给理论、新公共管理理论、委托代理理论三大理论出发,探讨了政府购买公共服务的理论依据,对我国政府购买公共服务的实践探索和制度设计进行了回顾和总结。结合现状分析,对我国政府购买公共服务招标环节、生产环节、监督环节的风险进行描述,并进行多角度的具体分析。在此基础上,建立博弈模型,重点分析政府购买公共服务过程中的招标、验收环节中作为“理性人”的各参与主体在政府购买公共服务过程中可能出现的各种行为及互动过程,揭示可能存在的风险,发现博弈均衡点,提出增加对权力寻租行为的惩罚力度、提升社会组织的公共服务供给能、建立多方监督体制、提升监督能力以及完善法律体系对于我国政府购买公共服务风险防范与控制具有重要作用。最后,结合国外政府购买公共服务的经验,提出完善我国政府购买公共服务的风险防范与控制机制需形成政府购买中卖方市场的竞争局面、完善法律体系、规范购买程序、加强对政府的监管、重视社会监督以及强化监督能力的建议。
[Abstract]:Government purchase of public services is a reform carried out by the government in order to change the functions of the government, innovate the mode of public service supply, improve the level of public service supply and improve the efficiency of fiscal expenditure. At present, from the central to the local, from the practice of exploration to the design of the system are advancing on a large scale, in the process of practice, the defects in the design of the government purchase system need to be studied and improved. The purpose of government purchasing public service is to break down the monopoly of public service supply for a long time, improve the supply level and efficiency of public service, and change the function of government. In recent years, the reform of government purchase of public services is advancing rapidly. However, in the process of practice, there are many potential risks, such as non-standard purchase process, lack of accountability mechanism, imperfect supervision mechanism and low supervision degree. Therefore, it is urgent to construct a risk prevention mechanism for government purchase of public services. Based on the three theories of public goods supply theory, new public management theory and principal-agent theory, this paper discusses the theoretical basis of government purchase of public services. This paper reviews and summarizes the practice and system design of government purchase of public services. Based on the analysis of the present situation, the paper describes the risks of the public service bidding, production and supervision links, and analyzes the risks from various angles. On this basis, a game model is established, which focuses on the analysis of bidding in the process of government purchase of public services, and various behaviors and interactive processes that may occur in the process of government purchase of public services as the "rational person" in the acceptance link. It reveals the possible risks, finds out the equilibrium point of the game, proposes to increase the punishment for the power rent-seeking behavior, to enhance the public service supply ability of the social organizations, and to establish a multi-party supervision system. Improving the supervision ability and perfecting the legal system play an important role in preventing and controlling the risk of government purchase of public services. Finally, based on the experience of foreign governments in purchasing public services, it is proposed that the risk prevention and control mechanism of government purchase of public services should form a competitive situation in the seller's market, perfect the legal system and standardize the purchase procedure. Strengthen the supervision of the government, pay attention to social supervision and strengthen the ability of supervision.
