我国社会保险基金社会监督问题研究

【摘要】：社会保险是我国人民群众的基本福利，关系到每个人的切身利益，而社会保险基金作为社会保障制度实施运转的物质基础，有着深远意义，它是国家经济发展和社会和谐安定的“减震器”和“安全阀”，是群众的“保命钱”和“养命钱”。社会保险基金的社会监督工作是我国人民群众当家作主的体现，同时也是我国建设阳光公共服务型政府的本质要求。社会保险基金运转的成败不仅关系到广大参保人员与相关利益者的权益，更关系到整个社会的安全与稳定。在这方面，中国有过深刻和沉重的教训。然而近年来我国政府对社会保险基金的监督工作非常重视，制定了一系列的政策制度，对我国社保基金的监督工作起到了很大的推动作用，，但基金监督不力问题、监督法制建设不完善等问题依然严重。尤其是社会监督，社会监督是社会保险基金监督体系的一个关键部分，监督功能依然非常弱，社保基金甚至有时被挤占、挪用。广大群众的基本生活保障与社保基金息息相关，为了保证我国社保基金的正常运转和高效运行，做好群众基本生活的保障工作，构建我国的社会保险基金社会监督体系，一个非常关键的措施就是做好社会监督工作。本文的主要内容包括：综述国内外学者对社保基金社会监督问题的研究成果；界定了社保基金监管和社会监督的概念，梳理了理论基础；以现有的社会保险运行及监管理论为根基，深入分析了我国社会保险基金社会监督的现状及问题；并结合国外在社会保险基金方面的监管经验，提出了建立和完善我国统一完整的社会保险基金社会监督体系的路径。本文创新之处在于：（1）文章在结合国外经验和我国国情的基础上，构建了我国统一、完整的社会保险基金社会监督体系，包括四大原则、三大机制和六大手段。（2）文章创新性的提出了在我国建立独立的由国务院垂直管理的“社会监督委员会”制度。
[Abstract]:Social insurance is the basic welfare of the people of our country , which is related to the personal interests of each individual , and the social insurance fund is the material basis for the operation of the social security system . The social supervision work of the social insurance fund is a key part of the public service - oriented government of our country . In recent years , the government has paid great attention to the supervision of the social insurance fund . In particular , the social supervision and social supervision is a key part of the supervision system of the social insurance fund . In the meantime , the social supervision of the social insurance fund is very weak . The social security fund is even occupied and misappropriated . In order to ensure the normal operation and the efficient operation of the social insurance fund , the social security fund is a key part of the social security fund , and the social supervision system of the social insurance fund is built , and a very key measure is to do well in social supervision .

The main contents of this paper include : a review of the research results of social supervision of social insurance funds at home and abroad ;
The concept of social security fund supervision and social supervision is defined , and the theoretical basis is combed .
Based on the existing social insurance operation and supervision theory , the present situation and problems of social supervision in China ' s social insurance fund are analyzed in detail .
Combined with foreign experience in social insurance fund , this paper puts forward the path of establishing and perfecting the social supervision system of social insurance fund .

The innovation of this paper is : ( 1 ) Based on the combination of foreign experience and the national conditions of our country , the article constructs a unified and complete social supervision system of the social insurance fund , including the four principles , three mechanisms and six means .
