北京市非京户籍人员社会保险费补缴问题研究

【摘要】：随着《社会保险法》的出台，社会保险体系的健全和完善，劳动者越来越关注自己的社会保险缴费情况。尤其是伴随北京购房、购车、子女上学等政策的相继出台，社会保险的参保缴纳情况不仅影响劳动者各项社保待遇的申领，同时其影响也渗透到了人们社会生活的各个领域。用人单位申请补缴、个人投诉补缴业务骤然上升，部分非京户籍人员为了满足补缴资格或与保险代理公司合谋伪造补缴材料，或与用人单位合谋变造补缴材料，或以重金诱惑社保工作人员为其提供便利，各种违规补缴行为应运而生。严重影响了社会保险制度的公平性，损害了正常参保单位与个人的合法权利。因此，本文在梳理非京户籍人员在京参保缴费和补缴政策的基础上，结合丰台区非京户籍人员社会保险费补缴情况、补缴审核制度落实情况，运用文献分析法、数据分析法和案例分析法归纳出非京户籍人员社会保险费断缴的原因、影响及社会保险费补缴存在的问题。并提出面对当前社会保险费补缴存在的突出问题北京市应全盘考虑各类因素，准确定位社会保险费补缴问题；应从社会保险政策制定和制度设计促进公平，以及改革和完善非京户籍人员社会保险费补缴制度的角度出发，正确引导和规范社会保险费补缴。本文对于非京户籍人员在京补缴社会保险问题的研究，适应了现阶段缓解限购政策实施过程中矛盾冲突的需求，对于北京的经济发展和社会和谐稳定具有明确的现实意义。文中从两个角度出发提出的相关建议，，不仅对完善社会保险参保缴费政策，促进社会保险制度体现公平和权利与义务对等等政策研究提供了参考。而且对规范社会保险补缴审核制度，具有强有力的实践指导意义。
[Abstract]:With the introduction of the Social Insurance Law and the perfection of the social insurance system, workers pay more and more attention to their social insurance contributions. Especially with the policies of buying houses, cars and children going to school in Beijing, the social insurance not only affects the social security benefits of workers, but also penetrates into every field of people's social life. When the employing unit applies for repayment, the individual complains about the sudden rise in the business of repaying. In order to satisfy the eligibility for repaying or colluding with the insurance agent company to forge the repaying materials, or to collude with the employing unit to alter the repaying materials, some non-Beijing registered residents, Or to entice social security staff to provide convenience, various illegal repayments came into being. It seriously affects the fairness of social insurance system and damages the legal rights of normal insured units and individuals. Therefore, on the basis of combing the policy of non-Beijing residents participating in insurance payment and repaying in Beijing, combined with the situation of repaying social insurance premiums of non-Beijing registered residents in Fengtai District, and the implementation of the repaying examination system, this paper applies the literature analysis method. The data analysis method and the case analysis method sum up the reasons of the non-Beijing registered permanent residents' social insurance premium withholding, the influence and the existing problems of the social insurance premium repaying. In the face of the outstanding problems existing in the repayment of social insurance premiums, Beijing should take all kinds of factors into consideration, accurately position the issue of repaying social insurance premiums, and promote fairness from the formulation of social insurance policies and the design of social insurance systems. From the point of view of reforming and perfecting the social insurance premium repaying system for non-Beijing registered permanent residents, we should correctly guide and standardize the social insurance premium repayment. This paper studies the issue of non-Beijing residents' repaying social insurance in Beijing, adapts to the need of alleviating the contradiction and conflict in the process of implementing the limited purchase policy at present, and has clear practical significance for Beijing's economic development and social harmony and stability. The relevant suggestions from two angles not only provide a reference for the policy research of perfecting the social insurance contribution policy, promoting the social insurance system to reflect fairness and rights and obligations, and so on. Moreover, it is of great practical significance to standardize the audit system of social insurance payment.
