基层工商部门居民美容机构预付式消费监管研究

【摘要】:随着市场经济的发展,预付式消费已经成为我国居民主要的一种消费方式之一,但是近年来预付式消费问题屡屡见诸报端,各种“卷包会”、“人间蒸发”现象时有发生,其中又以美容机构最为突出。全国各地居民美容机构预付式消费的投诉居高不下,已经严重影响了正常的市场秩序,为消费者造成巨大的经济损失。这些美容机构预付式消费案例大部分呈现了事前缺乏监督、事中缺乏监督管理、事后维权艰难的特点。基层工商部门是美容机构预付式消费的主要监管机构之一,特别是对于美容行业的日常经营活动监管主要依靠基层工商部门监管。基层工商部门一直在市场经济体系中站在经济监管的最前沿,直接接触经济活动中的大量中小企业、个体工商户以及广大普通消费者,对其监管进行研究是十分必要的。 笔者多年一直服务于基层工商部门,本文结合实际工作情况,运用了案例分析法、归纳分析法等多种研究方法,通过基层工商部门对美容机构预付式消费监管的研究分析,以发现基层工商部门在该领域监管活动中存在的问题,找出其背后的原因并进行分析总结。 最后,论文提出了基层工商部门对美容机构预付式消费监管的对策,即①加强配套法律法规建设;②建立准入管理制度;③结合基层工商部门现有监管方式,加强日常监控和预警;④改进现有监管模式;加大12315社会宣传,增强全社会的认识,,提高消费者的维权能力。
[Abstract]:With the development of market economy, prepaid consumption has become one of the main consumption modes in our country. However, in recent years, the problems of prepaid consumption have frequently appeared in the newspapers, and various kinds of "volume envelopes" and "evaporation" have occurred from time to time. One of the most prominent beauty agencies. The high number of prepaid consumer complaints from beauty agencies throughout the country has seriously affected the normal market order and caused huge economic losses to consumers. Most of these prepaid consumption cases of beauty agencies show the characteristics of lack of supervision, supervision and management, and difficulty in safeguarding rights afterwards. The basic industry and commerce department is one of the main supervision organizations of the beauty agency's prepaid consumption, especially the supervision of the daily business activities of the beauty industry mainly depends on the supervision of the basic level industry and commerce department. Grassroots industrial and commercial departments have been standing in the forefront of economic supervision in the market economy system. It is necessary to directly contact a large number of small and medium-sized enterprises, individual industrial and commercial households and general consumers in economic activities. The author has been serving the grass-roots industry and commerce department for many years. In this paper, combined with the actual working situation, the author used the case analysis method, the inductive analysis method and other research methods, through the grass-roots industry and commerce department to the beauty agency prepaid consumption supervision research analysis. In order to find out the problems existing in the supervision and control activities of the grass-roots industry and commerce department, find out the reasons behind it and carry on the analysis and summary. Finally, the paper puts forward the countermeasures of the prepaid consumption supervision of beauty agencies by the grass-roots industry and commerce department, that is, to strengthen the construction of supporting laws and regulations and to establish the admission management system and the existing supervision mode of the grass-roots industry and commerce department. Strengthen the daily monitoring and early warning to improve the existing regulatory model, increase the 12315 social publicity, enhance the understanding of the whole society, improve the ability of consumers to protect their rights.
