【摘要】：由于城镇化建设的推进,从上世纪九十年代以来,特别是进入本世纪后,我国进入了城镇房屋拆迁高峰期,拆迁人与被拆迁人围绕拆迁补偿多少及其相应权益保障问题,产生了激烈的矛盾,并不断出现类似“最牛钉子户”、“自焚”等事件,引发了一系列社会问题。在我国,城镇土地属国家所有,并由《土地法》加以规范,对城镇房屋征收则由《城镇房屋拆迁管理条例》规范,这是我国特有的征收制度。在房屋拆迁中,被拆迁人失去的不仅仅是地上的房屋,还有房屋所占的土地使用权。根据《物权法》的精神,拆迁补偿应对被拆迁人因房屋拆迁而造成的全部物权损失进行足额补偿,但《我国房屋拆迁条例》没有将土地使用权这一独立物权纳入补偿范围,没有为被拆迁人的“全面”、“足额”补偿提供法律支持。同时,在引入市场资本参与城市旧区改造后,地方政府与拆迁人利益关系日益密切,行政部门在房屋拆迁许可证发放、拆迁补偿定价等方面,无不偏袒拆迁人。当拆迁人与被拆迁人产生矛盾时,行政部门则通过行政裁决方式庇护拆迁人,是典型的“自己做自己的法官”,使被拆迁人无法取得完善的法律救济途径作为兜底保障,这也注定拆迁人与被拆迁人利益冲突必然成为一个城市矛盾最为突出的地方。本文分析了株洲市城镇房屋拆迁的主要模式,主要包括、第三方评估补偿模式、统一拆迁模式、强制拆迁模式等,同时文章提出株洲市房屋拆迁存在拆迁信息不对称、补偿标准不统一等五个方面的主要问题。同时,文章采用从经济学的角度出发,对株洲市城镇房屋拆迁主体相关三方利益和被拆迁者的利益述求进行了深入的分析,指出了城市房屋拆迁的利益冲突的焦点和根源。对此,文章提出了城镇房屋拆迁必须遵从的主要工作原则,提出了解决株洲市城镇化房屋拆迁矛盾冲突的具体对策建议：公开拆迁信息,营造和谐舆论氛围、制定完善的补偿标准、强化对房屋拆迁中相关行为的监管、和建立以人为本的观念。文章的理论研究可以为解决城市拆迁矛盾冲突提供理参考建议,并可以促进城镇化建设进程和加快推进和谐社会的构建。

In our country, urban land belongs to the state ownership and is regulated by the land law. This paper analyzes the main mode of urban housing demolition in the city of Zhuzhou, including the third party evaluation, compensation mode, unified removal mode, forced relocation mode, at the same time the housing demolition of Zhuzhou city the main problems of five aspects of information asymmetry, the demolition compensation standard is not unified. At the same time, from the perspective of economics, the article makes an in-depth analysis of the three party interests and the interests of the relocated people in Zhuzhou's urban housing demolition, and points out the focus and root of the conflict of interests in the urban housing demolition. In this regard, the article puts forward the main working principle of urban housing demolition must follow, put forward specific measures and suggestions to solve the urbanization of Zhuzhou city housing demolition demolition conflict: public information, create a harmonious atmosphere of public opinion, strengthen the formulation of compensation standard, perfect concept of housing demolition related behavior supervision, and establish a people-oriented. The theoretical research of the article can provide some suggestions for solving the conflicts and conflicts in urban demolition, and promote the process of urbanization and accelerate the construction of a harmonious society.
