我国大城市高铁站区综合开发中土地增值收益分配机制研究

【摘要】:为了促进我国高速铁路建设的可持续发展,高铁站区综合开发被寄予厚望。在铁路部门体制改革和国家政策支持的背景下,高铁站区综合开发依然进展较为缓慢。因此,探讨造成我国高铁站区综合开发难以实现的原因,成为急需解决的问题。通过对现有研究的梳理总结,本文发现,高铁站区综合开发中土地增值收益分配机制的不完善是阻碍高铁站区综合开发的主要原因之一。在文献综述基础之上,本文试图探讨现行制度下我国大城市高铁站区综合开发过程中土地增值的形成与分配。本文发现,现行制度下,假设我国建设用地使用权分层划分制度已经完善,既有高速铁路站区综合开发过程中土地增值收益分配对地方政府而言不公平,新建高速铁路站区综合开发过程中土地增值收益分配对铁路主体而言不公平,而缺少土地增值收益公平分配的机制阻碍了我国大城市高铁站区综合开发。然后,本文系统整理并比较了国内外高速铁路(轨道交通)站区综合开发中的土地增值收益分配机制。最后,本文结合我国当下的现实情景,从中选取了适合的完善我国大城市高铁站区综合开发过程中土地增值收益分配机制的办法。关于我国大城市既有高速铁路站区综合开发中土地增值收益分配机制,近期可采用地方政府和铁路主体共同参与土地开发并共享土地开发环节的增值收益的方式,远期在铁路主体具备开发能力后,可采用铁路主体在负责公共配套设施建设或缴纳一定的配套费用后自主开发的方式。关于我国大城市新建高速铁路站区综合开发中土地增值收益分配机制,近期宜采用税收返还方式,其可细分为两种方式,一是地方政府将税收返还给铁路主体,二是合理确定高铁站区没建高铁时的平均地价、再将土地出让金中多出部分返还给铁路主体;远期在铁路主体具备开发能力后,可采用通过确定周边土地没建高铁时的区域平均地价,以此价格将周边土地使用权出让给轨道主体,由铁路主体自主开发或与开发商合作开发的方式。
[Abstract]:In order to promote the sustainable development of high-speed railway construction in China, the comprehensive development of high-speed railway stations is highly expected. The comprehensive development of high-speed railway station area is still slow. Therefore, it is an urgent problem to explore the reasons why the comprehensive development of high-speed railway station area in our country is difficult to realize. Through combing and summarizing the existing research, this paper finds out that the comprehensive development of high-speed railway station area is difficult to achieve. The imperfection of land value-added income distribution mechanism in the comprehensive development of high-speed railway station area is one of the main reasons that hinder the comprehensive development of high-speed railway station area. This paper attempts to discuss the formation and distribution of land increment in the process of comprehensive development of high-speed railway stations in big cities of China under the current system. Assuming that China's construction land use right stratification system has been improved, the existing high-speed railway station area comprehensive development process of land value-added income distribution to the local government is unfair. In the process of comprehensive development of new high-speed railway station area, the distribution of land value-added income is unfair to the main body of railway, but the lack of mechanism of fair distribution of land value-added income hinders the comprehensive development of high-speed railway station area in big cities of our country. This paper systematically arranges and compares the land value-added income distribution mechanism in the comprehensive development of high-speed railway (rail transit) stations at home and abroad. Finally, this paper combines the current situation of our country. The method of land value-added income distribution in the process of comprehensive development of high-speed railway stations in big cities of China is selected. On the Distribution Mechanism of Land Value-added income in Comprehensive Development of existing High-speed Railway stations in Big cities of China. . In the near future, the local government and the railway main body can participate in the land development and share the value-added income of the land development link, in the long run, after the railway main body has the development ability. The main body of the railway can be developed independently after taking charge of the construction of the public supporting facilities or paying a certain amount of matching fee. About the land value-added income distribution mechanism in the comprehensive development of the newly-built high-speed railway stations in the big cities of our country. In the near future, tax return should be adopted, which can be subdivided into two ways, one is that the local government will return the tax to the main railway, the other is to reasonably determine the average land price when there is no high-speed railway in the high-speed railway station area. And then return the more part of the land transfer fee to the railway main body; After the main body of the railway has the ability to develop, it can be used to determine the regional average land price of the surrounding land when the high-speed rail is not built, so as to transfer the right to use the surrounding land to the main body of the track. The way by which the main body of the railway is independently developed or developed in cooperation with the developer.
