商事登记改革下的个体私营经济协会发展研究

【摘要】：自20世纪80年代至今,社会团体等非政府组织的迅猛发展,深刻地改变着这个世界。它们参与到企业等主体的社会化管理,参与到民生事业的承揽建设,在促进经济发展、完善国家法制建设、社会文明进步等方面起到了不可忽视的作用。在我国,个体私营经济协会,是由个体劳动者协会、私营企业协会合并而成的组织,简称个私协会,属于非政府组织,协会的基本架构和运行模式拥有非政府组织的一般共性特征。本文以西湖区个体私营经济协会作为研究对象,结合商事登记制度改革的背景,以非政府组织理论为切入点,对个体私营经济协会进行深入调查和分析。笔者发现,在目前的政治、经济体制环境下,西湖区个体私营经济协会和全国的其他协会一样,已经难以达到建会的初衷,表现出来的问题有会员没有归属感、协会职能不明显、缺乏独立运作的能力等,究其原因主要有协会行政色彩浓厚致使独立性缺乏、社会角色不清晰、人才与资金不足等。而目前行政体制改革带来的政府简政放权、注册登记制度改革带来的市场主体更加活跃,为个体私营经济协会的发展提供了契机,笔者结合自身工作实践,提出了去行政化思维、增强协会筹集和管理资金能力、搭建企业发展服务平台、成为政府监管助手、实施公益服务品牌战略、增强协会自我监督能力等六条路径,让个私协会更好发展。
[Abstract]:Since the 1980 s, the rapid development of NGOs such as social groups has profoundly changed the world. They are involved in the socialized management of enterprises and other subjects, and in the undertaking construction of people's livelihood, which plays an important role in promoting economic development, perfecting the construction of national legal system, and the progress of social civilization and so on. In our country, individual and private economic associations are organizations formed by the merger of individual workers' associations and private enterprise associations, or private associations, which belong to non-governmental organizations. The basic structure and operating mode of the Association have the general common features of NGOs. Based on the background of the reform of commercial registration system and the theory of non-governmental organizations, this paper makes a thorough investigation and analysis of the private and individual economic associations in Xihu District. The author found that under the current political and economic system environment, the private and individual economic associations in the West Lake region, like other associations throughout the country, have been unable to achieve the original intention of establishing the Commission, showing problems with members who do not have a sense of belonging. The function of the association is not obvious and the ability of independent operation is lacking. The main reasons are the lack of independence, the unclear role of the society, the shortage of talents and funds, and so on. At present, the reform of the administrative system brings the government to simplify the power of administration, and the reform of the registration and registration system brings more active market subjects, which provides an opportunity for the development of the individual and private economic associations. It puts forward six ways to deadministrate, strengthen the ability of raising and managing funds of the association, set up the service platform for enterprise development, become the assistant of government supervision, implement the brand strategy of public service, and strengthen the ability of self-supervision of the association. Let the private association develop better.
