基于合约关系视角的PPP项目公众利益保障的初步研究

【摘要】：随着我国经济的快速发展,城市规模的不断扩大,城市基础设施的需求越来越大,单纯依靠政府已无法满足需求。政府部门为缓解财政压力,加大建设力度为公众提供更快更优质的服务而引入了PPP模式。近年来,PPP模式在我国基础设施领域得以较快发展,不仅涉及桥梁、隧道、供水供电等传统公用事业领域,还延伸到医院、学校及保障性住房等领域,国家也出台了一系列政策鼓励PPP模式的推行。但PPP模式在我国实际应用与发展过程中出现了诸多问题,PPP项目失败的案例屡见不鲜,其中由于PPP项目的准公共产品性和垄断性等特性决定其与公众利益息息相关并导致公众利益受到损害的情况发生,引起公众不满,甚至引发社会矛盾与冲突,造成极为不好的社会影响,因此在国内PPP项目的实施过程中,如何确保项目相关公众利益的有效实现以成为无法回避的关键性问题。该论文分析了PPP模式的概念及特性,结合公众利益的概念及特征,得出PPP项目公众利益的内涵,作为研究公众利益保障的理论依据。同时该论文对PPP项目的合约主体与合约关系进行了研究,使基于合约关系视角进行PPP项目公众利益保障问题的研究成为可行。该论文通过一些典型PPP项目的案例研究,分析PPP项目公众利益受到损害的现状,并从合约主体与合约关系两个视角剖析了该现状发生的原因。在此基础上针对现状发生的原因,提出政府公共部门、私营合作伙伴等PPP项目合约主体进行公众利益保障的相关思路和合约主体在构建合约关系过程中保障公众利益实现的对策与建议。
[Abstract]:With the rapid development of our economy and the expansion of urban scale, the demand for urban infrastructure is increasing, and it is impossible to meet the demand by relying solely on the government. The PPP model was introduced to relieve financial pressure and provide faster and better service to the public. In recent years, the PPP model has developed rapidly in the field of infrastructure in China. It not only involves traditional public utilities such as bridges, tunnels, water supply and power supply, but also extends to hospitals, schools and affordable housing. The country also issued a series of policies to encourage the implementation of the PPP model. However, there are many problems in the application and development of PPP model in China. Due to the quasi-public goods and monopoly characteristics of the PPP project, it is closely related to the public interest and leads to the damage of the public interest, causing public dissatisfaction, and even social contradictions and conflicts. Therefore, how to ensure the effective realization of the public interests of the PPP project is an unavoidable key issue in the implementation of PPP projects in China. This paper analyzes the concept and characteristics of the PPP model, combines the concept and characteristics of the public interest, obtains the connotation of the public interest of PPP project, as the theoretical basis for the research of the public interest protection. At the same time, this paper studies the contract subject and contract relationship of PPP project, which makes it feasible to study the protection of public interest in PPP project from the perspective of contract relationship. Through some typical PPP project case studies, this paper analyzes the current situation of public interest damage in PPP project, and analyzes the causes of the situation from the perspective of contract subject and contract relationship. On this basis, in view of the causes of the current situation, the paper puts forward the government public sector, Private partner and other PPP project contract subjects to protect the public interests of the relevant ideas and contract subjects in the process of building a contract relationship to protect the public interest in the realization of countermeasures and suggestions.
