论我国法定退休年龄制度的完善

【摘要】:法定退休年龄是退休制度的一个非常重要的方面,影响着整个退休制度的每个参加者。同时也对社会经济发展有深远的影响力。我国法定退休年龄随着退休制度的建立而确定,建立起以正常退休年龄为主,同时还以提前退休和延迟退休为补充的退休年龄体系。自上世纪五十年代,已经过了半个多世纪的运行,期间虽有进行着小幅度调整,但基本保持稳定。我国法定退休年龄制度在多年的运行中发挥了积极作用,对社会经济发展起到了巨大推动作用。但是在变化了的社会大环境下,我国法定退休年龄制度也逐渐暴露出诸多问题:提前退休被滥用,退休年龄群体差异过大,退休年龄呈现整体低龄化趋势,也还存在对农民群体的忽视和制度本身规范混杂,立法层次不高,需要整合的问题。因此,法定退休年龄制度需要在原有基础和法律框架下进行完善,以便更好的适应新形势下利益需求多元化的要求,以适应社会大背景的变化,完善自身发展。我国法定退休年龄制度完善具有现实的复杂性,需要以现行法律法规规定为基础,综合社会经济环境的现实情况,考虑各主体的利益平衡而推进,采取渐进式推进的方法,规范提前退休适用,逐步缩小不同群体之间退休年龄的差异,并逐步在更广泛的地区和行业中实施弹性退休年龄制度。同时,采取相应配套制度和改革措施,协调推进我国法定退休年龄制度的完善。
[Abstract]:The statutory retirement age is a very important aspect of the retirement system, affecting every participant in the entire retirement system. At the same time, it also has far-reaching influence on social and economic development. The legal retirement age in China is determined with the establishment of the retirement system. The retirement age system is mainly based on the normal retirement age and is supplemented by early retirement and delayed retirement. Since the 1950s, it has been running for more than half a century. Although a small adjustment has been made during the period, it is basically stable. China's legal retirement age system has played a positive role in the operation of many years, and played a great role in promoting the socio-economic development. However, in the changing social environment, the legal retirement age system in China has gradually exposed a number of problems: early retirement is abused, retirement age groups are too different, retirement age presents an overall low-age trend. There are also some problems such as neglecting the peasant group and regulating the system itself, and the legislative level is not high, which needs to be integrated. Therefore, the legal retirement age system needs to be perfected under the original foundation and legal framework, so as to better adapt to the diversified needs of interests under the new situation, in order to adapt to the changes in the social background and improve their own development. The perfection of the legal retirement age system of our country has the realistic complexity, needs to take the current laws and regulations as the foundation, synthesizes the social economic environment reality situation, considers each main body's benefit balance and advances, adopts the gradual advancement method, We should standardize the application of early retirement, gradually reduce the difference of retirement age among different groups, and gradually implement the flexible retirement age system in a wider range of regions and industries. At the same time, the corresponding supporting system and reform measures are adopted to coordinate and promote the perfection of the legal retirement age system in China.
