我国商事登记制度改革生态性研究

【摘要】：商事登记制度改革是我国现阶段社会经济体制改革的热点和重点。随着我国市场经济的发展，行政管理体制的创新，以及文化观念的变化，经济体制和社会管理体制改革持续深入，商事登记在制度设计方面的缺陷逐渐显现。商事登记制度改革的生态性研究就是指研究既存的商事登记制度及其变革中的制度要素、制度运作与社会环境及其相互作用关系，改造并促使商事登记制度自我演化实现平衡的研究。以商事制度改革社会生态研究为基础和指导，进一步推进我国商事登记制度改革，构建适应我国国情的规范化、程序化、现代化的商事登记法律制度，对完善我国社会主义市场经济体制巨有重大的现实意义。本文的具体内容如下：首先是绪论部分，即关于本选题的来源、意义、研究现状和创新点、研究思路、研究方法的综述。第一章，商事登记制度改革及其生态的学理分析，就现阶段的热点事件，商事登记制度改革及其试点作为切入点，剖析这一改革的背景、内容、和意义，考察商事登记的内涵、特点、功能，，确定商事登记行为的法律性质和以及商事登记制度的价值取向。第二章，国外商事登记模式及其社会生态比较研究，考察不同登记模式的代表国家社会生态方面的差异，以及对我国的启示。第三章，我国商事登记制度改革的政治生态研究，分析我国商事登记制度改革的政治生态环境，探讨政府、社会组织、商事主体个人的权利，定位其角色，完善商事登记中的相关行为制度。第四章，我国商事登记制度改革的经济生态研究，探究中国经济体制改革、市场经济模式的转型、商主体自由经营权的发展这些经济环境的改变对我国商事登记制度改革的影响以及制度完善。第五章，我国商事登记制度改革的文化生态研究，探究传统文化因素，表现在政府工作中的“官本位”文化、社会交往中的“关系”文化、以及商事主体个人“信用”文化对商事登记制度改革的影响以及制度完善。
[Abstract]:The reform of commercial registration system is the focus and focus of social economic system reform at present . With the development of market economy , the innovation of administrative management system , and the change of cultural idea , the reform of economic system and social management system has gradually appeared . The first is the introduction part , that is , the source , significance , research situation and innovation point , the research thinking and the research method of this topic . The first chapter , the reform of commercial registration system and its ecological theory analysis , analyzes the background , content and significance of the reform , analyzes the background , content and significance of the reform , investigates the connotation , characteristics and functions of the commercial registration , and determines the legal nature of the commercial registration behavior and the value orientation of the commercial registration system . The second chapter , the foreign business registration model and its social ecological comparison research , investigates the differences between the different registration patterns on behalf of the national social ecology , and the inspiration to our country . In the third chapter , we study the political ecology of the reform of commercial registration system in our country , analyze the political ecological environment of the reform of commercial registration system in our country , probe into the rights of the government , the society organization and the commercial subject , locate its role and perfect the relevant behavior system in the commercial registration . The fourth chapter , the economic and ecological study of the reform of the commercial registration system in China , explores the transformation of China ' s economic system , the transformation of the market economy model , the development of the business right of the commercial subject , and the influence of the changes of the economic environment on the reform of the commercial registration system in China and the perfection of the system . The fifth chapter , the cultural ecology research of the reform of the commercial registration system in our country , explores the traditional cultural factors , displays the " relation " culture in the government work , the " relation " culture in the social intercourse , and the influence of the individual " credit " culture on the reform of the commercial registration system and the perfection of the system .
