阳江市区流动摊贩管理研究

【摘要】：流动摊贩管理问题是现代城市管理中的一个难点问题，随着城市化和工业化进程的加快，城市人口迅速增长，一些因年龄、技能、文化等因素所限难以找到合适工作的人群不断加入到流动摊贩大军中来。同时，因摆地摊成本低、市场需求旺盛，一些非法追逐暴利的人群也加入到其中，这也导致了流动摊贩管理越来越复杂了。近年来，阳江城管跟流动摊贩间的冲突也是不断增多，城管执法越来越受到质疑，，执法工作也逐渐陷入困局。本文通过对阳江市区流动摊贩管理现状进行研究，指出阳江目前流动摊贩管理中存在的一些问题并对问题的原因进行了分析，通过借鉴国内外其他城市相对成熟的管理经验，针对性地提出了阳江市区流动摊贩管理对策，转变简单粗暴的执法执法观念，确立以人为本的法治观念，让公众参与到流动摊贩管理中来，并改变政府一元化管理体制，以公众满意为导向进行管理。根据社会冲突理论，指出城管跟流动摊贩冲突的根源在于利益的失衡，通过城管、摊贩、市民等的多方利益平衡来处理各方矛盾，解决冲突。最后提出进一步加强流动摊贩疏导点建设和管理来开展目前阳江的流动摊贩管理工作，通过疏堵结合的方式来引导流动摊贩规范经营，从而改善阳江目前城管执法难题。
[Abstract]:The management of mobile vendors is a difficult problem in modern urban management. With the acceleration of urbanization and industrialization, the urban population is growing rapidly, some due to age and skills. Culture and other factors make it difficult for people to find suitable jobs to join the army of mobile vendors. At the same time, because of the low cost of setting up stalls and the strong market demand, some people who illegally pursue profiteering also join in. In recent years, the conflict between urban management and mobile vendors in Yangjiang has been increasing, the law enforcement of urban management has been more and more questioned, and law enforcement has gradually fallen into difficulties. By studying the current situation of the management of mobile vendors in Yangjiang city, this paper points out some problems existing in the management of mobile vendors in Yangjiang, and analyzes the causes of the problems, and draws lessons from the relatively mature management experience of other cities at home and abroad. This paper puts forward the management countermeasures of mobile vendors in Yangjiang urban area, changes the concept of simple and rough law enforcement, establishes the concept of rule of law based on people, lets the public participate in the management of mobile vendors, and changes the unified management system of the government. According to the theory of social conflict, it is pointed out that the root of the conflict between urban management and mobile vendors lies in the imbalance of interests. Finally, it is proposed to further strengthen the construction and management of mobile vendors' dredging points to carry out the current management work of mobile vendors in Yangjiang, and to guide the mobile vendors to regulate their operation through the combination of diversion and blockage. In order to improve the current Yangjiang urban management law enforcement difficulties.
