公共采购招投标背景下利益相关者伦理行为模式与决策策略研究

【摘要】:招标投标是市场经济制度比较完善的国家在大宗货物买卖、工程建设等领域普遍应用的交易方式。招标投标也在我国经济建设领域内逐渐推行,正发挥着越来越积极的作用。为了规范招标投标活动,我国分别于2000年1月1日颁布了《中华人民共和国招标投标法》、2012年2月1日颁布了《中华人民共和国招标投标法实施条例》,同时,各部门及各省相应制定了一系列的法规、标准和实施办法,使招标投标活动有章可循,有法可依。在市场竞争日趋激烈的今天,招投标中各利益相关者都希望在这场博弈活动中获得最大收益,所以,各方都会以自己的出发点和利益目标来进行活动,其行为模式也直接影响着招投标各方的决策过程和效果。在市场许可的条件下,抓住影响招投标决策的主要因素,建立和规范招投标的管理机制,促使招投标主体进行合法、合规的市场竞争,这是本文欲解决的核心问题。 本文从招投标过程中利益相关者的行为过程入手,首先介绍“招投标”、“利益相关者”、“伦理行为决策”等基本概念,建立起本文的基本理论体系,并提出本文的总体构思框架;其次结合5个典型案例和访谈研究总结出各利益相关者伦理失范的表现形式和影响其伦理行为决策的主要变量,并对各主要变量的特征、维度及其关系进行了验证;最后,通过情景实验的方式验证了构恩模型中的主要变量之间的关系。本文梳理了影响招投标过程的各种因素,探寻影响招投标中利益相关者的主要因素,分析其伦理行为模式,使其在规范的伦理行为中实现各自利益和即期目标。 本研究无疑有着重要的社会意义和现实意义。通过科学的研究结果,我们辨别出公共采购招投标活动中的主要影响因素,理清了各主要因素之间的相关关系,从而进一步规范招标投标活动、维护公平竞争的市场经济秩序、提高资源利用效率、降低交易成本,预防和遏制腐败,具有积极的社会意义。同时,我们以此为依据,加强对招投标活动进行有针对性的制度设计,协助各利益相关者提高自身业务素质,加强自律,帮助企业提高自身综合实力,有着十分现实的意义。
[Abstract]:Tendering and bidding is a widely used trading method in the fields of bulk goods trading, engineering construction and so on in countries with relatively perfect market economy system. Bidding and bidding is also gradually being carried out in the field of economic construction in our country. Is playing a more and more active role. In order to regulate the bidding activities, China promulgated the Law on bidding and bidding of the people's Republic of China on January 1st 2000 and regulations on the implementation of the Law on bidding and bidding of the people's Republic of China on February 1st 2012. At the same time, various departments and provinces formulated a series of laws and regulations accordingly. Standards and implementation methods, so that the bidding activities have rules to follow, there are laws to follow. In the increasingly fierce market competition today, all stakeholders in bidding hope to get the maximum benefit in this game activity, so, Each party will carry out its activities with its own starting point and interest goal, and its behavior pattern will directly affect the decision-making process and effect of the bidding parties. Under the condition of market permit, the main factors affecting the bidding decision will be grasped. To establish and standardize the management mechanism of bidding and to urge the subject of bidding to compete legally and legally in the market is the core problem to be solved in this paper. Starting with the behavior process of stakeholders in the process of bidding, this paper first introduces the basic concepts of "bidding", "stakeholder", "ethical behavior decision" and so on, establishes the basic theoretical system of this paper, and puts forward the overall conceptual framework of this paper. Secondly, combined with five typical cases and interviews, the paper summarizes the manifestation of ethical anomie of stakeholders and the main variables that affect their ethical behavior decision-making, and verifies the characteristics, dimensions and relationships of the main variables. The paper verifies the relationship between the main variables in the constitutive model by the way of situational experiment. This paper combs the various factors that affect the bidding process, explores the main factors that affect the stakeholders in bidding, and analyzes its ethical behavior model. In order to achieve their own interests and immediate goals in the normative ethical behavior. There is no doubt that this study has important social and practical significance. Through the scientific research results, we identify the main influencing factors in the public procurement bidding activities, and clarify the correlation between the main factors. Therefore, it is of positive social significance to further standardize the bidding activities, maintain the order of fair competition in the market economy, improve the efficiency of resource utilization, reduce transaction costs, prevent and contain corruption, and at the same time, we take this as the basis, It is of great practical significance to strengthen the system design of bidding activities, to assist stakeholders to improve their professional quality, to strengthen self-discipline and to help enterprises improve their comprehensive strength.
