人民内部矛盾理论视野下城管与小贩的矛盾研究

【摘要】：近年来，城市管理行政执法者（以下简称城管）与本钱很少的行商（以下简称小贩）之间的冲突不断，越来越激烈的矛盾引起了人们的广泛关注。当维持整个城市整齐有序、健康运行的城管部门遇上处于底层维护一个人作为最基本生存权的弱势群体；当小贩屡禁不止，影响城市的美丽有序，城管暴力侵犯小贩的生存权，城管与小贩暴力相持，硝烟不断的战争便层出不穷，此起彼伏。如果对城管与小贩的矛盾弃之不理，任其恶化，那么不良群体事件的发生便不可避免，为了国家的安稳，城市的健康运行，人民的安居乐业，解决城管与小贩的冲突迫在眉睫，，因此，如何缓解二者之间的矛盾也越来越受到人们的关注和重视。人民内部矛盾是国家政治生活的主题。在我国，还存在大量的社会矛盾，城管与小贩的矛盾作为众多人民内部矛盾中的一个，是处理人民内部矛盾的重要部分。缓和了城管与小贩的矛盾问题，实际上就为缓和人民内部矛盾踏上了一个大的台阶。本文将在人民内部矛盾理论的视角下，在实际调查、深入分析和仔细总结城管与小贩二者的矛盾过程中，分析导致两者冲突的原因，再结合人民内部矛盾理论找出缓解城管与小贩矛盾的可行的、具有操作性的对策，期望能为进一步化解城管与小贩的冲突提供一些有用的理论参考和实际意义。因此，整篇论文分为以下四部分：第一部分，绪论。介绍本论文研究的背景、研究意义及国内外研究现状等。第二部分，关于当前城管与小贩的矛盾现状分析（以深圳为例）。对当前城管与小贩的现状进行调查研究，在此基础上总结二者的矛盾表现，并分析当前城管与小贩矛盾加剧的危害。第三部分，对城管与小贩冲突的原因进行分析。在第二部分调查研究、综合分析的基础上，从不同的角度分析城管与小贩冲突的原因。第四部分，论述缓解城管与小贩矛盾的对策。根据第二、三部分的分析，从四个不同的角度提出缓解城管与小贩矛盾的相关对策。
[Abstract]:In recent years, the conflicts between urban management law enforcers (hereinafter referred to as chengguan) and operators with little capital (hereinafter referred to as hawkers) are constantly in conflict, and more fierce contradictions have aroused people's widespread concern. When maintaining the whole city neat and orderly, the healthy operation of the urban management department meets the underprivileged group that maintains a person as the most basic right of survival at the bottom; When hawkers are repeatedly banned, affecting the city's beauty and order, chengguan violence infringes on hawker's right to survival, chengguan and hawker violence continue to fight, incessant war, one after another. If the contradiction between urban management and hawker is abandoned and allowed to deteriorate, then the occurrence of adverse group events is inevitable. For the sake of the country's stability, the healthy operation of the city, the people's peace and contentment, it is urgent to resolve the conflict between the urban management and the hawker. Therefore, how to alleviate the contradiction between the two has been paid more and more attention. Contradictions among the people are the theme of the country's political life. In our country, there are still a lot of social contradictions. As one of the contradictions among the people, the contradiction between urban management and hawker is an important part of dealing with the contradictions among the people. The contradiction between chengguan and hawker has been alleviated, in fact, the contradiction among the people has stepped on a big step. From the perspective of the theory of contradiction among the people, this paper will analyze the causes of the conflict between urban management and hawker in the process of actual investigation, in-depth analysis and careful summing up of the contradiction between urban management and hawker. Combining with the theory of contradiction among the people, this paper finds out feasible and operable countermeasures to alleviate the contradiction between urban management and hawker, hoping to provide some useful theoretical reference and practical significance for further resolving the conflict between urban management and hawker. Therefore, the whole paper is divided into the following four parts: the first part, introduction. This paper introduces the research background, research significance and research status at home and abroad. The second part, about the current urban management and hawker contradiction analysis (taking Shenzhen as an example). The present situation of urban management and hawker is investigated and studied. On the basis of this, the contradiction between chengguan and hawker is summarized, and the harm caused by the intensification of contradiction between chengguan and hawker is analyzed. The third part analyzes the causes of conflict between chengguan and hawkers. On the basis of the investigation and comprehensive analysis in the second part, the causes of conflict between chengguan and hawker are analyzed from different angles. The fourth part discusses the countermeasures to alleviate the contradiction between urban management and hawker. According to the analysis of the second and third parts, this paper puts forward the relevant countermeasures to alleviate the contradiction between urban management and hawker from four different angles.
