小产权房的治理机制研究

【摘要】:在我国城市化和住房商品化进程中,小产权房蔓延现象一直未得到有效地治理,引起了社会各界的广泛关注。治理效果不理想的主要原因在于治理机制不健全。本文基于治理理论和公众参与理论研究小产权房的治理机制,为解决我国小产权房问题提供一个根本途径。 通过调查分析小产权房的市场现状和整治现状,发现在小产权房的整治过程中存在几个值得关注的问题,具体表现在:由政府主导的管制,忽视了村民、购房者等相关方的利益诉求;政府与民间利益相关方之间缺乏有效的沟通与协商;村民和购房者等利益相关者处于被动、弱势地位,参与意识淡薄,且参与程度低。而产生这些问题的原因是:未从法律上规定小产权房治理应遵循的具体操作标准和程序,使村民、购房者等相关群体的利益表达机制缺失;小产权房治理理念缺失,信息公开、意见反馈、沟通和协商等机制不健全;缺乏为实现有效治理提供保障的组织系统。 针对小产权房治理中存在的主要问题,运用治理理论和公众参与理论,提出了小产权房的治理机制,包括法律制度、组织体系、信息公开、沟通、协商和意见反馈机制等。指出建立和完善小产权房治理的法律制度、第三方监督与协调、信息公开、意见反馈、沟通和协商等治理机制,是实现小产权房有效治理的基本保障。阐述了小产权房治理机制的运行模式及过程,从治理草案的准备、治理方案的制定与实施、治理效果评价和总结等阶段分别描述了运行过程中各阶段的主要工作。 通过文本分析和问卷调查,识别出阻碍小产权房治理机制形成与发展的18个一般因素。运用主成分分析法从中提取出5个关键障碍因素,其中政府与民间利益相关者之间缺乏沟通与反馈机制且治理责任不明确是目前阻碍小产权房治理机制形成与发展的首要因素。此外,政府对待小产权房治理的态度不清晰、相关法律与政策制度不完善、缺少增进政府与民间利益相关者相互沟通和协商的中间组织以及缺乏行之有效的方法和公开透明、制度化的程序等,也是阻碍小产权房治理机制形成与发展的主要因素。针对这些主要障碍因素,提出了完善与治理机制相关的法律和制度、提高公众参与治理的意识和能力、重视治理组织系统的建设、完善治理程序和环节等对策和具体建议。 研究成果的应用有助于促进小产权房治理理论与实践的发展,明确我国小产权房治理机制形成与发展的方向,,为实现小产权房的有效治理提供了一个基本的途径。
[Abstract]:In the process of urbanization and commercialization of housing in China, the phenomenon of the spread of small property houses has not been effectively managed, which has caused widespread concern from all walks of life. The main reason why the governance effect is not ideal is that the governance mechanism is not perfect. Based on the governance theory and the public participation theory, this paper studies the governance mechanism of the small property house, which provides a fundamental way to solve the problem of the small property house in our country. Through the investigation and analysis of the market situation and the regulation situation of the small property house, it is found that there are several problems worthy of attention in the process of the renovation of the small property house, which is manifested in: the government dominates the control, neglecting the villagers, Housing buyers and other stakeholders' interest demands; the lack of effective communication and consultation between the government and non-governmental stakeholders; villagers and buyers and other stakeholders in a passive, vulnerable position, weak sense of participation, and low level of participation. The reasons for these problems are that the specific operating standards and procedures that should be followed in the governance of small property houses are not stipulated in the law, so that the interest expression mechanism of the villagers, buyers and other related groups is missing, the concept of small property housing governance is missing, and the information is open to the public. Feedback, communication, consultation and other mechanisms are not perfect; lack of effective governance for the implementation of the organizational system. In view of the main problems existing in the governance of the small property right house, this paper applies the governance theory and the theory of public participation, and puts forward the governance mechanism of the small property right house, including the legal system, the organization system, the information disclosure, the communication, the consultation and the opinion feedback mechanism and so on. It is pointed out that establishing and perfecting the legal system, third party supervision and coordination, information publicity, opinion feedback, communication and consultation are the basic guarantee to realize the effective governance of the small property house. This paper expounds the operation mode and process of the governance mechanism of the small property right house, and describes the main work of each stage in the operation process from the preparation of the governance draft, the formulation and implementation of the governance scheme, the evaluation and summary of the governance effect, etc. Through text analysis and questionnaire survey, the paper identifies 18 general factors that hinder the formation and development of small property right housing governance mechanism. Five key obstacle factors were extracted by principal component analysis, among which the lack of communication and feedback mechanism between government and non-governmental stakeholders and unclear governance responsibility are the primary factors hindering the formation and development of small property rights housing governance mechanism. In addition, the government's attitude towards the governance of small property houses is not clear, the relevant legal and policy systems are not perfect, there is a lack of intermediate organizations to promote communication and consultation between the government and private stakeholders, and there is a lack of effective methods and transparency. The institutionalized procedure is also the main factor that hinders the formation and development of the management mechanism of the small property right house. Aiming at these main obstacle factors, this paper puts forward some countermeasures and concrete suggestions, such as perfecting the law and system related to governance mechanism, improving the consciousness and ability of public participation in governance, paying attention to the construction of governance organization system, perfecting the procedure and link of governance, and so on. The application of the research results is helpful to promote the development of the theory and practice of the management of the small property house, to make clear the direction of the formation and development of the governance mechanism of the small property house in our country, and to provide a basic way to realize the effective management of the small property house.
