【摘要】：我国是一个农业大国,三农问题是我国经济社会发展的关键。党的十八大报告明确提出：“要健全基层党组织领导的充满活力的基层群众自治机制,以扩大有序参与、推进信息公开、加强议事协商、强化权力监督为重点,拓宽范围和途径,丰富内容和形式,保障人民享有更多更切实的民主权利。”也就是在农村通过村民自治使广大农民直接行使民主权利,依法办理自己的事情。村民自治的核心是村民自治权,村民自治权的实现有利于推进中国民主宪政进程,使宪法规定的公民权利在农村基层社会得到落实,推动社会主义民主法治的进步。但村民自治权的实现受到各种因素的影响,如现有立法不完善、村民自治权的行使形式化、农村经济落后、村民的民主法治意识不强。要实现村民自治权就要完善立法、规范村民自治权的行使、促进经济的发展、提高村民民主法治意识。本文将村民自治权作为研究的切入点,以内蒙古五原县胜丰镇为例运用实证分析的方法对我国村民自治权的实现从三部分进行分析：第一部分对我国基层村民自治权的基础理论进行分析,介绍了村民自治权的相关概念、综述了中西方关于基层自治的法律规定、提出村民自治权实现的价值；第二部分分析我国基层村民自治权的实现困境及其原因,从村民自治组织机构及其职能和村民自治权的内容深入分析困境及存在这些困境的原因；第三部分分析我国村民自治权实现的对策,完善村民自治权实现的法律制度,提高农民的科学文化水平和民主法治意识,促进农村经济和社会的发展。
[Abstract]:Our country is a big agricultural country, the issue of "agriculture, countryside and farmers" is the key of our country's economic and social development. The report of the 18 National Congress of the Communist Party of China (CPC) puts forward clearly: "We should perfect the vigorous mechanism of grassroots mass autonomy under the leadership of grass-roots party organizations." In order to expand orderly participation, promote information disclosure, strengthen consultation, strengthen power supervision as the focus, broaden the scope and ways to enrich the content and form. To ensure that the people enjoy more and more practical democratic rights... "that is to say, in rural areas, the majority of peasants can directly exercise their democratic rights through villagers' autonomy and handle their own affairs according to law. The core of villagers' autonomy is the villagers' autonomy. The realization of villagers' autonomy is conducive to promoting the process of democratic constitutionalism in China, so that the civil rights stipulated in the Constitution can be implemented in the rural grassroots society. Promote the progress of socialist democracy and rule of law. But the realization of villagers' autonomy is affected by various factors, such as imperfect legislation, formal exercise of villagers' autonomy and backward rural economy. The villagers' consciousness of democracy and rule of law is not strong. In order to realize villagers' autonomy, we must perfect legislation, standardize the exercise of villagers' autonomy, promote the development of economy and raise villagers' consciousness of democratic rule by law. This article regards the villagers' autonomy as the starting point of the research. Taking Shengfeng Town of Wuyuan County Inner Mongolia as an example the realization of villager autonomy in China is analyzed from three parts: the first part analyzes the basic theory of villager autonomy at the grass-roots level in our country. This paper introduces the related concepts of villagers' autonomy, summarizes the legal provisions of basic level autonomy between China and the West, and puts forward the value of the realization of villagers' autonomy. The second part analyzes the difficulties and causes of the realization of the villagers' autonomy at the grass-roots level in China, and analyzes the difficulties and the reasons for these difficulties from the perspective of the organization and functions of the villagers' autonomy and the content of the villagers' autonomy. The third part analyzes the countermeasures of the realization of villager's autonomy in our country, consummates the legal system of the realization of villager's autonomy, raises the farmer's scientific and cultural level and the consciousness of democracy and rule of law, and promotes the development of rural economy and society.
