【摘要】： 改革开放以来,伴随着我国经济全球化步伐的加速,农业经济发展迅速,农村许多居住地呈现出粗放型的经济增长方式,致使一系列环境问题产生,影响了农村经济社会的健康发展。农村生活着2亿多户,农业户籍人口8.7亿人,直接在农村地区村庄生活的接近8亿人。农村人居环境的改善是农村环境治理中不可逾越的部分。农村居住地的环境问题主要表现在：新兴农村聚居地环境污染问题、乡村旅游业带来的污染、污染企业向农村转移所带来的污染、对农村整体人居建筑环境的破坏和农业化肥与农药使用所造成的环境问题。整体上,我国农村整体环境污染严重、生态持续恶化。国家提出新农村建设目标与要求,社会主义新农村建设要求农村人居环境、生活条件应向村容整洁、乡风文明转变。然而,长期以来我国对人居环境的研究都集中在城市领域,农村居住地人居环境制度研究却很少。基于此，，本文试图通过对农村居住地现存的环境问题及其原因的分析,并借鉴其他国家的经验,提供我国农村居住环境在技术改善和法制建设方面的建议,其具体思路如下：第一章,绪论部分,从整体上阐明问题提出的背景和意义、研究方法与目标。第二章,阐述了我国新农村建设与农村人居环境的内涵,提出农村人居环境建设目标。第三章,总结农村聚居地人居环境主要存在问题,分析各种污染的现状和危害,借鉴其他地方的经验,提出了改善农村人居环境的技术措施和成功发展模式。第四章,农村人居环境保护法律制度的构建,包括,农民环境权的保护、修改《环境保护法》、制定和修改相关的单行法、调整和完善农村人居环境标准、其他部门法中关于农村人居环境保护的规定、我国参加的国际条约和国际惯例中相关的法律规定。第五章,结论与讨论。
[Abstract]:Since the reform and opening up, with the accelerated pace of economic globalization in China, the rapid development of agricultural economy, many rural settlements show extensive economic growth mode, resulting in a series of environmental problems. It has affected the healthy development of rural economy and society. There are more than 200 million households living in rural areas, and the population of agricultural households is 870 million. Nearly 800 million people live directly in villages in rural areas. The improvement of rural residential environment is an insurmountable part of rural environmental governance. The environmental problems of rural settlements are mainly manifested in:. Environmental pollution in emerging rural settlements. The pollution brought by rural tourism, the pollution caused by the transfer of polluting enterprises to rural areas, the environmental problems caused by the destruction of the environment of human settlements in rural areas and the use of agricultural fertilizers and pesticides. The whole environment pollution in the countryside of our country is serious, the ecology continues to deteriorate. The country puts forward the new rural construction goal and the request, the socialism new countryside construction requests the rural human settlement environment, the living condition should be clean and tidy to the village. However, for a long time, the research on human settlement environment in China has been concentrated in the urban field, but the research on the residential environment system in rural areas is rare. Based on this, this paper tries to analyze the existing environmental problems of rural residence and its causes, and learn from the experience of other countries, and provide suggestions on the technical improvement and legal system construction of rural living environment in China. The specific ideas are as follows: the first chapter, the introduction part, from the overall explanation of the background and significance of the problem, research methods and objectives. Chapter two, elaborated the connotation of the new rural construction and rural human settlements environment in China. The third chapter summarizes the main problems in rural settlements, analyzes the current situation and harm of various pollution, and draws lessons from the experience of other places. The technical measures and successful development model of improving rural human settlements environment are put forward. Chapter 4th, the construction of legal system of rural human settlements environmental protection, including the protection of farmers' environmental rights, the revision of Environmental Protection Law. We should formulate and amend the relevant laws, adjust and improve the standards of rural human settlements, and other laws on the protection of rural human settlements. Relevant legal provisions in international treaties and international practice to which China is a party. Chapter 5th, conclusion and discussion.
