哈耶克自生秩序与法治中国的理论探求

【摘要】：弗里德里希·奥古斯特·冯·哈耶克是二十世纪一位多才多艺的学者。哈耶克涉足经济学,政治学、法学等领域。这样广博的学术背景使他具有自身独特的学术视角去观察法学,法治问题。他对自由,法律等方面所做出的贡献众所周知。正是由于哈耶克在受到西方成熟市场经济长期熏陶,且一直从事经济学研究,使他在法学领域的理论具有了独特的视角和切入点。十八届四中全会提出依法治国战略。法治的改革护航经济的发展,经济的先行给法治完善提供强大的物质后盾。对哈耶克这样一位既有经济学理论背景又深诣于法学理论学者的思想进行研究,势必会对中国法治建设有着重要的理论与现实意义。研究法治这个舶来品从西方自由主义角度切入对知识传统的增量意义重大。哈耶克的“自生秩序”是建立在个人的正当行为规则之上的,更是站在巨人的肩膀上。曼德维尔、休谟、罗尔斯、康德、弗格森、门格尔等的争议二元论,有限理性架构、第三范畴、演进机制对哈耶克思想的形成乃至成熟有着重要影响。文章从规则问题的引入为起点。由浅入深的将'自生秩序'语境的法治问题结合到中国的实践中,以期对中国法治理论的突破与法治实践的前进提供些许启迪。
[Abstract]:Friedrich Auguste von Hayek was a versatile scholar in 20th century. Hayek dabbled in economics, politics. Such extensive academic background makes him have his own unique academic perspective to observe the law, the rule of law. The contributions made by law and other aspects are well known. It is precisely because Hayek has long been influenced by the mature market economy in the West and has been engaged in the study of economics. The fourth Plenary session of the 18 CPC Central Committee put forward the strategy of governing the country according to law and the reform of the development of escort economy by the rule of law. The advance of the economy provides a strong material backing for the improvement of the rule of law. Hayek, who has both the economic theoretical background and the deep attainments of the thought of the legal theory scholars. It is bound to be of great theoretical and practical significance to the construction of China's rule of law. The study of the rule of law as an import is of great significance to the increment of knowledge tradition from the angle of western liberalism. Hayek's "order of self birth" Is based on individual rules of proper conduct. On the shoulders of giants. Mandeville, Hume, Rawls, Kant, Ferguson, Mengel, etc. The controversial dualism, limited rational framework, category three. The evolution mechanism has an important influence on the formation and maturation of Hayek's thought. From the introduction of the rule of law, this paper combines the rule of law in the context of 'born order' into the practice of China. In order to provide some enlightenment for the breakthrough of Chinese rule of law theory and the progress of the practice of rule of law.
