构建社会主义和谐社会视域下法治建设研究

【摘要】：社会和谐作为中国特色社会主义的本质属性,不仅是我们努力追求的理想和目标,更是党肩负的巨大使命。构建和谐社会,必须按照民主法治的特点,坚持和完善全面依法治国战略,为和谐社会建立稳定的环境基础和必要的制度保障。论文以马克思主义基本原理为理论基础,以和谐社会的实践为出发点,以法治建设为研究对象,论述了社会主义和谐社会、法治建设以及二者之间的关系,系统的探索了和谐社会下法治建设的相关途径。首先,阐述了和谐社会与法治建设的关系。法治建设既是构建和谐社会的必然要求,也是构建和谐社会的重要保障。和谐社会是以人为本的法治理念为基本前提、安定有序的法治社会为坚固基础,公平正义的法治结果为实践标志的法治社会;法治建设保障了和谐社会的家庭关系、公民关系、人与自然关系的和谐。其次,分析了我国和谐社会构建过程中的某些法治缺失现象,探寻了由于公民权利保障体系不充分,立法体系有待健全,执法严谨性有待加强等问题而导致社会失之和谐的深层根源。最后,通过分析上述现象产生的原因,针对性的提出了社会主义和谐社会下法治建设的相关措施,通过树立公民法律至上理念、增强守法护法意识和提高公正司法意识来培育公民牢固的社会主义法治信仰;强化立法的科学性与时效性、执法的严谨性与公正性和监督的健全性和民主性来完善社会主义法治体系;保护弘扬社会正气,建立全面奖惩制度、加强改进党的领导,贯彻全面依法治国和改革吏治,发挥政府在法治建设中的引领作用来加强法治道德舆论导向等。社会主义和谐社会并非一朝一夕之工作,法治建设也并非一成不变。唯有坚持不懈,拾级而上,逐渐完善法治建设,推动和谐社会早日实现。
[Abstract]:As the essential attribute of socialism with Chinese characteristics, social harmony is not only the ideal and goal that we strive to pursue, but also the great mission of the Party. To build a harmonious society, we must follow the characteristics of democracy and rule of law. Adhere to and improve the overall strategy of governing the country according to law, to establish a stable environment for a harmonious society and necessary institutional protection. The paper takes the basic principles of Marxism as the theoretical basis and the practice of a harmonious society as the starting point. Taking the construction of the rule of law as the research object, this paper discusses the socialist harmonious society, the construction of the rule of law and the relationship between the two, and systematically explores the relevant ways of the construction of the rule of law under the harmonious society. This paper expounds the relationship between the harmonious society and the construction of the rule of law. The construction of the rule of law is not only the inevitable requirement of constructing the harmonious society, but also the important guarantee of the construction of the harmonious society. The harmonious society is the basic premise of the people-oriented concept of the rule of law. The stable and orderly society of rule of law is a firm foundation, and the result of the rule of law of fairness and justice is a society of rule of law marked by practice; The construction of the rule of law ensures the harmonious relationship of family, citizen, man and nature in a harmonious society. Secondly, it analyzes some phenomena of lack of rule of law in the process of building a harmonious society in China. This paper explores the deep causes of the loss of social harmony due to the insufficiency of civil rights protection system, the need to improve the legislative system, and the need to strengthen the law enforcement. Finally, through the analysis of the reasons for the above phenomenon. Put forward the relevant measures of the construction of the rule of law under the socialist harmonious society, through the establishment of the concept of the supremacy of civil law. Strengthening the consciousness of law-abiding protection and judicial justice to cultivate citizens' firm belief in socialist rule of law; To perfect the socialist legal system, we should strengthen the scientific nature and timeliness of legislation, the preciseness and impartiality of law enforcement and the soundness and democracy of supervision; We should protect and carry forward the good spirit of the society, establish a comprehensive system of rewards and punishments, strengthen and improve the leadership of the Party, and carry out the comprehensive administration of the country according to law and the reform of officials. Give play to the leading role of the government in the construction of the rule of law to strengthen the guidance of public opinion on the rule of law. Socialist harmonious society is not overnight work, the rule of law construction is not static. Gradually improve the construction of the rule of law, promote the early realization of a harmonious society.
