【摘要】：《行政许可法》的颁布实施,对于我国民主与法制建设产生重大而深远的影响,建立法制统一、公正廉洁、便民高效的政府是我国现代民主与法制建设的目标;行政许可法中的默示制度行政许可法中引入默示制度是对传统行政法明示许可的一个挑战,因此在适用行政许可默示制度时,应严格而准确的判定默示制度是否可以使用,使默示制度在行政法中发挥真正意义上的利益平衡、提高行政效率、促进行政法发展的作用。第一部分从民法中的默示概念入手,论述了默示与明示、默示与沉默的区别,对默示意思推定进行了阐述,引出行政许可默示制度,并对行政许可默示制度的性质、概念、分类进行了详细的分析,目的在于使人们对行政许可默示制度有较为系统化的认识,并对行政法中的默示制度与民法中的默示制度的区别进行了分析,突出行政许可默示制度的特点,使人们更清楚的认识和理解行政许可默示制度。第二部分分析了国内外的立法实践,主要讲了葡萄牙、意大利、台湾地区和澳门地区的立法经验,并结合我国的最新立法实践“超时默许”制度进行分析,目的在于为我国行政许可默示制度的完善提供依据。第三部分根据我国行政许可默示制度的实践,分析出我国实行行政许可默示制度存在的不足和问题。第四部分根据第三部分的不足提出立法建议,完善我国行政许可默示制度的不足。
