法治之美的源发性

【摘要】：作为社会系统中的调整机制,法治之美内生于主体—境遇—客体的动态结构以回应社会生活,具有规范性、合理性、合道德性的价值形态、生活形态与文化形态,外源于制度的生活化而具有真实性和导向性。认识风习视域下的法治之美,有助于展现法治的社会性、文化性和伦理性,避免陷入工具主义窠臼。
[Abstract]:As the adjustment mechanism in the social system, the beauty of the rule of law is born in the dynamic structure of subject-situation-object in response to social life. It has normative, rational, moral value form, life form and cultural form. Understanding the beauty of the rule of law from the perspective of practice helps to show the sociality, culture and ethics of the rule of law and avoid falling into the rut of instrumentalism.
