中国食品安全法制建设研究

【摘要】:2011年3月14日十一届全国人大四次会议审议通过了《国民经济和社会发展第十二个五年规划纲要》,十二五规划纲要始终贯穿着改善民生的主题,食品药品监管更是得到了进一步体现。纲要指出:“制定和完善食品药品安全标准。建立食品药品质量追溯制度,形成来源可追溯、去向可查证、责任可追究的安全责任链。健全食品药品安全应急体系,强化快速通报和快速反应机制。加强食品药品安全风险监测评估预警和监管执法,提高监管的有效性和公信力”。由此可见国家对食品安全问题给予了足够的重视。随着近年来国内食品安全事件的频繁爆发(包括不久前上海发生的“柠檬色素”馒头事件),食品安全问题已经引起了全社会普遍的关注。食品安全不仅关系到人民群众的生命健康和财产安全,情况严重的还将影响整个国家的社会稳定和国民经济的发展。在此情况下,《食品安全法》应运而生,《食品安全法》对中国食品安全问题的解决起到了很大的作用,然而,仅仅是一部法律的出台并不足以解决中国食品安全的所有问题。我国当前的食品安全法律主要有法律、法规、规章等,其制定主体多样化,食品安全标准的不统一,食品安全监管职责分段分部门实施等等一系列制度规范极易造成权力的消极冲突,使得出现食品安全问题各监管部门无人问津,消费者在出现食品安全问题之后投诉无门。笔者试图通过对法制建设、食品安全法制建设等相关概念的进一步界定,对当前中国食品安全法制建设主要内容的论述,对中国食品安全法制建设历史演进的阐述,对国内外食品安全法律制度的分析比较,详细论证我国食品安全法制建设存在问题,明确加快建设食品安全法律制度的必要性,树立以人为本的科学法制理念,以马克思主义法学为指导,倡导尽快制定统一的食品安全标准法,进一步梳理监管主体,完善司法责任追究制,形成统一完善的中国的食品安全法律制度,促进我国食品安全法制建设,为食品安全立法、执法和司法提供可能的帮助,从而为最终实现“十二五”期间国民寿命提高一岁打下良好的安全饮食基础。①
[Abstract]:In March 14th 2011, the fourth session of the Eleventh National people's Congress deliberated and adopted the Twelfth Five-Year Plan for National Economic and Social Development, which has always been running through the theme of improving people's livelihood. The food and drug supervision has been further embodied. The outline points out: "formulate and improve food and drug safety standards. Establish a food and drug quality traceability system to form sources that can be traced back and where to go can be verified." The chain of safety responsibility that can be investigated for responsibility. Improve the emergency system of food and drug safety, strengthen the mechanism of rapid notification and rapid response, strengthen the monitoring, assessment, early warning and supervision of food and drug safety risks, and enforce the law. "to improve the effectiveness and credibility of regulation," it can be seen that the state has given sufficient attention to food safety issues. With the frequent outbreak of domestic food safety incidents in recent years (including the recent "Lemon pigment" in Shanghai). The issue of food safety has aroused widespread concern in the whole society. Food safety is not only related to the life and health of the people, but also to the safety of property. If the situation is serious, it will also affect the social stability of the whole country and the development of the national economy. In this case, the Food Safety Law has emerged as the times require, and the Food Safety Law has played a great role in solving the problem of food safety in China. However, The promulgation of a law alone is not enough to solve all the problems of food safety in China. The current food safety laws in China mainly include laws, regulations, rules, etc., the main body of which is diversified, and the food safety standards are not unified. The implementation of a series of institutional norms such as the implementation of a series of regulations on the responsibility of food safety supervision in sub-departments is prone to create a negative conflict of power, resulting in the emergence of food safety problems that are left unattended by the various regulatory authorities. The author tries to discuss the main contents of the current food safety legal construction in China through the further definition of related concepts such as legal construction, food safety legal construction and so on. This paper expounds the historical evolution of China's food safety legal system, analyzes and compares the domestic and foreign food safety legal systems, demonstrates in detail the existing problems in the construction of China's food safety legal system, and clarifies the necessity of speeding up the construction of the food safety legal system. To establish the scientific and legal concept of people-oriented, guided by Marxist jurisprudence, to advocate the formulation of a unified food safety standard law as soon as possible, to further comb the main body of supervision, and to improve the system of judicial accountability. To form a unified and perfect food safety legal system in China, to promote the construction of the food safety legal system in China, and to provide possible assistance for food safety legislation, law enforcement and the administration of justice. Thus for the ultimate realization of the 12th Five-Year Plan, the national life expectancy increased by one year to lay a good foundation for a safe diet .1
