特留份制度及其在我国的法制构造

【摘要】：特留份制度可溯至罗马法和日耳曼法。现代大多数国家及地区都设立了特留份制度或类似制度,总的呈现出适当限制遗嘱自由、充分发挥其制度功能和逐步完备其制度内容的态势。我国《继承法》仅规定了保护"双缺人"和婴儿利益的必留份制度,不能很好地解决以遗嘱剥夺亲密继承人的继承权问题,在我国引入特留份制度很有必要。我国应当主要借鉴大陆法模式,形成特留份与必留份制度并存的立法体例,细化权利主体、具体份额及扣减制度,既尊重被继承人的遗嘱自由又维护亲密继承人的合法利益。
[Abstract]:The retention system can be traced back to Roman law and Germanic law. In most countries and regions of modern times, the retention system or similar system has been established, which in general presents appropriate restrictions on the freedom of wills. Giving full play to its system function and gradually perfecting the situation of its contents, the inheritance Law of our country only stipulates the mandatory share system to protect the interests of "double missing persons" and infants, and it cannot solve the problem of depriving the close heirs of the inheritance rights by will. It is necessary to introduce the special retention system in our country. Our country should mainly draw lessons from the model of continental law, form a legislative system in which the special retention system and the mandatory share system coexist, and refine the subject of the right, the specific share and the deduction system. Respect for the decedent's freedom of will while defending the legitimate interests of close successors.
