欧盟科学、民主立法保障机制研究:以法律起草为例

【摘要】：科学立法和民主立法是现代立法的两大原则,也是保证立法质量和法律获得社会尊重的重要前提。欧盟立法机构制定法律的过程较好地贯彻了这两个原则。本文首先论述了欧盟保证科学立法的机制和具体措施,然后阐述了欧盟确保民主立法的机制和措施,其中,文章分别从社会学的角度探究和论证了这些机制和措施所产生的功效。在此基础上,作者得出结论:欧盟已经建立了较完备的保证科学立法和民主立法的机制和措施,这也是欧盟法不仅得到欧盟各机构的尊重,而且得到欧盟各成员国遵守的重要原因。
[Abstract]:Scientific legislation and democratic legislation are the two main principles of modern legislation. It is also an important premise to ensure the quality of legislation and the respect of law. The process of making laws in EU legislative organs has carried out these two principles well. This paper first discusses the mechanism and concrete measures of EU to ensure scientific legislation. Then it expounds the mechanisms and measures to ensure democratic legislation in the EU. Among them, the article explores and demonstrates the effectiveness of these mechanisms and measures from a sociological perspective. The author concludes that the EU has established more complete mechanisms and measures to guarantee scientific and democratic legislation, which is an important reason for EU law to be respected not only by EU institutions, but also by EU member states.
