“普遍同意”还是“普遍满意”——民主实践的正当性基础研究

【摘要】：近些年来,为了拓展公民行动的范围和领域、深化民主的程度,民主研究发生了审议转向。审议民主欲将公民的"普遍同意"视为民主实践的正当性基础,并试图通过公共论证的途径来寻求公民的"普遍同意"。然而,随着公民个人权利的不断成长和丰富,有必要将民主实践的正当性基础置于公民的"普遍满意"之上。对承担着治理职能,扮演着治理角色的民主实践来说,寻求令公民感到"普遍满意"的方案比规划令公民感到"普遍同意"的公共论证更根本。
[Abstract]:In recent years, in order to expand the scope and field of civic action and to deepen the extent of democracy, there has been a shift in the study of democracy, which seeks to consider citizens'"general consent" as the legitimate basis of democratic practice. And try to seek the "general consent" of citizens through the way of public argumentation. However, with the continuous growth and enrichment of individual rights of citizens, It is necessary to place the legitimate foundation of democratic practice above the "universal satisfaction" of citizens. A program that seeks to make citizens feel "generally satisfied" is more fundamental than planning a public argument that makes them feel "generally agreed."
