农村拆迁工作的法治化研究

【摘要】：农村“拆迁难”实质上是利益多样化、复杂化背景下社会关系调整中利益矛盾和纠纷的集中释放，是市场经济发展过程中不同利益主体之间和新旧利益分配规则之间的直接碰撞、摩擦、博弈。破解“拆迁难”，首先应当全面、深入剖析当前困扰农村拆迁工作的现实、历史成因，明晰拆迁实体利益关系合理界定的困难，如目前农村住房私下买卖的法律规定不明确，农村“非农业户口”人员住房保障政策不完善，离婚户申请建房政策设置不周全，宅基地使用管理不规范等等。此外，农村拆迁程序工作机制运行还存在弊病，法律、政策宣传解释功能的“体制性错位”，信息公开、民主参与工作机制的“程序性缺位”。笔者认为，随着城镇化进程的推进，农村拆迁日趋增多，成为乡镇街道的重要项目，因而研究农村拆迁问题，对乡镇街道的拆迁工作推进更具有现实意义。“和谐拆迁”理念指导下的拆迁，需要法治为基础的井然有序的法治秩序。在此基础上，妥善解决拆迁矛盾，推进农村拆迁工作的法治化，，可以借鉴国外的经验，拆迁工作既要符合法律政策，又要尊重历史状况，还要考虑实际生活需要。综合说，可以从完善农村土地使用管理法律制度、加快城乡统筹建设步伐、推进信息公开和扩大民主参与等层面，为拆迁利益关系的合理界定提供制度保障，为利益关系人表达主张、化解矛盾提供程序保障，为拆迁农民的生活变迁提供社会保障，构建农村拆迁工作的法治化体系，以适应农村经济社会变迁的发展趋势和新形势下矛盾纠纷化解的客观需要。
[Abstract]:In fact, the difficulty of demolition in rural areas is the diversification of interests, and the concentrated release of conflicts of interest and disputes in the adjustment of social relations under the complicated background.It is the direct collision, friction and game between the different interest subjects and the new and old benefit distribution rules in the development of market economy.In order to solve the problem of "demolition and relocation difficulties", we should first of all thoroughly and thoroughly analyze the reality, historical causes and reasonable definition of the relationship of interests of the entities involved in the demolition of rural areas, such as the unclear legal provisions on the private purchase and sale of rural housing at present.Rural "non-agricultural hukou" personnel housing security policy is not perfect, divorce households apply for housing construction policy is not comprehensive, residential land use and management is not standardized, and so on.In addition, there are drawbacks in the operation of the working mechanism of the rural demolition and relocation procedure, the "institutional dislocation" of the functions of propaganda and interpretation of laws and policies, the disclosure of information, and the "procedural absence" of the working mechanism of democratic participation.The author thinks that with the advancement of urbanization, the rural demolition is increasing day by day and becomes an important project of the township street. Therefore, it is of practical significance to study the problem of the rural demolition and relocation to promote the demolition of the township street.Under the guidance of the concept of "harmonious demolition", the orderly legal order based on the rule of law is needed.On the basis of this, properly solving the contradiction of demolition and promoting the rule of law in rural demolition can draw lessons from the experience of foreign countries. The demolition work should not only conform to the law and policy, but also respect the historical situation, and also consider the actual needs of life.To sum up, we can improve the legal system of land use management in rural areas, accelerate the pace of urban and rural construction as a whole, promote the openness of information and expand democratic participation, so as to provide a system guarantee for the reasonable definition of the interest relationship between demolition and demolition.To provide procedural protection for stakeholders, to resolve contradictions, to provide social security for the life changes of peasants, and to build a legal system of rural demolition.In order to adapt to the development trend of rural economic and social changes and the objective need of resolving contradictions and disputes under the new situation.
