基层协商民主视野下的拆迁纠纷化解

【摘要】：破解拆迁难题与完善基层协商民主密切相关。拆迁既具有协商属性,又存在很高的协商难度,既具有复杂性,又具有可解决性。拆迁协商难源于三重因素交织:多元诉求多层主体是正常之难,是拆迁涉及高额利益分配的客观常态;各主体非制度化协商盛行是反常之难,其可能引发矛盾累积、新增、升级,是拆迁难题的核心症结;公共舆论的过度解读削弱了拆迁协商属性,进一步加剧协商困难。当前拆迁博弈处于高风险的中间状态:未达到基层协商民主理想状态,也并非皆是剧烈对抗,而是充斥灰色策略博弈。非制度化协商是基层治理回避和遮蔽矛盾的产物,反映地方政府维稳政治、承包制、社区自治三层治理结构的异化。化解拆迁复杂矛盾需大力推进广泛多层制度化的基层协商民主,其代表着正视矛盾的态度,蕴含着化解矛盾的艺术,是法治框架下的"柔性治理"。
[Abstract]:Solving the problem of demolition is closely related to the improvement of grass-roots consultative democracy.Demolition has not only negotiation attribute, but also high negotiation difficulty, complexity and solvability.The difficulty of relocation negotiation originates from the interweaving of three factors: the multilevel subject is normal and the objective normal that the relocation involves the distribution of high benefits; the prevalence of non-institutionalized negotiation of each subject is abnormal, which may lead to the accumulation of contradictions and increase.Upgrading is the core of the problem of demolition, and the excessive interpretation of public opinion weakens the attribute of relocation negotiation and further exacerbates the difficulty of negotiation.The current demolition game is in the middle state of high risk: it does not reach the ideal state of grass-roots consultative democracy, nor is it all violent confrontation, but full of grey strategy game.Non-institutionalized consultation is the product of the contradiction between the grass-roots governance and the shelter, which reflects the alienation of the three-tier governance structure of the local government, which is stable politics, contract system and community autonomy.To resolve the complex contradiction of demolition and relocation, we should vigorously promote the extensive multi-layer institutionalized grass-roots consultative democracy, which represents the attitude of facing up to contradictions, contains the art of resolving contradictions, and is "flexible governance" under the framework of the rule of law.
