论协商民主下依宪执政的共同体属性

【摘要】：基于共同体理论对协商民主下的依宪执政展开方法论层面的本源式研究,有助于在理念模式上全面解析该问题,从而为既存现实问题的整全性校正提供可能的方向指引。作为理想类型之协商民主下的依宪执政共同体是一种有效解决协商民主下依宪执政体制机制中各类具体问题的共同社会治理生活,其成就与否往往取决于共同体所特有的关系存续属性与系统调整属性能否在协商民主下的依宪执政实践中彰显出来。该类共同体应具备的互助化关系存续属性主要通过共同体各方成员彼此间的有机结合以及共同体与共同体各方成员生成的默认一致行动而实现,其应具备的自足化系统调整属性则主要通过共同体中预设权威所推进的良性统治而显现出来。
[Abstract]:Based on the community theory, the original research on the constitutional governance methodology level under deliberative democracy is helpful to the analysis of the problem on the conceptual model, thus providing possible direction for the correction of the integrality of the existing practical problems.As an ideal type of consultative democracy, the constitutional ruling community is an effective solution to various specific problems in the system of constitutional governance under the consultative democracy.Its achievement or not often depends on whether the relationship between the community and the system of adjustment can be manifested in the constitutional governance practice under the deliberative democracy.This kind of community should have the mutualization relation existence attribute mainly through the organic union among the members of the community and the tacit concerted action between the community and the members of the community.The self-contained system adjustment attribute is mainly revealed by the benign rule promoted by the presupposition authority in the community.
