民国时期新疆经济法制建设研究（1912-1944）

【摘要】： 无论是以往的历朝历代还是现在,经济法律制度在国家法制体系中都有着举足轻重的作用。虽然民国时期十分短暂,但却是一个由旧到新,逐步转变的时代,尤其是经济法制的发展,正处于向近代化急剧转变的过程。民国时期新疆的经济法制也处于不断发展和完善的时期,也是新疆地方法制史上承前启后的时期。因此,对民国时期新疆经济法制建设的研究具有一定的历史和现实意义,这也正是本文研究的主要目的。本文从三个方面来进行论述。第一部分阐述了民国时期新疆经济法制建设的背景,包括社会概况,经济发展概况。第二部分阐述民国时期新疆经济法制建设的主要内容,从不同时期分别考察新疆不同经济领域的法制建设情况,经济法律制度的演变。第三部分对民国时期新疆经济法制建设进行评价。本文主要利用文献史料,通过揭示民国时期新疆经济法制建设的发展演变历程,深入了解新疆经济法制产生以及发展的环境影响和历史动因,廓清历史事实,希望对新疆现阶段的经济法制建设,尤其是经济立法及实践提供借鉴。
[Abstract]:The economic legal system plays an important role in the national legal system, whether in the past dynasties or now.Although the period of the Republic of China was very short, it was a time of gradual change from the old to the new, especially the development of the economic legal system, which was in the process of rapid transformation to modernization.During the period of the Republic of China, the economic legal system of Xinjiang is also in the period of continuous development and perfection, and it is also a period of connecting the past and the future in the history of Xinjiang's local legal system.Therefore, the study of economic legal system construction in Xinjiang during the period of the Republic of China has certain historical and practical significance, which is the main purpose of this paper.This paper discusses from three aspects.The first part expounds the background of the economic legal system construction in Xinjiang during the Republic of China, including the general situation of society and economic development.The second part expounds the main contents of the economic legal system construction in Xinjiang during the period of the Republic of China, and examines the legal construction in different economic fields and the evolution of the economic legal system in Xinjiang from different periods.The third part evaluates the economic legal construction of Xinjiang during the period of the Republic of China.This article mainly uses the literature historical data, through reveals the Xinjiang economic legal system construction development evolution course, deeply understands the Xinjiang economic legal system production, the development environment influence and the historical motive, dissects the historical fact.This paper hopes to provide reference for the construction of economic legal system, especially the economic legislation and practice in Xinjiang.
